U.S. Customs and Border Protection Participating Government Agency (PGA) Access to CBP’s ACE Portal

2 Customs and Border Protection (CBP) systems provide access to a variety of sensitive information:  Law Enforcement Data (Counter-Terrorism, Counter-Narcotics)  Trade-Sensitive Data (Business and Personal -Confidential)  Business Processes used by CBP to protect our borders and enforce our laws Federal laws specify penalties for misuse:  Federal Information Security Management Act of 2002  Trade Secrets Act  Privacy Act  Fines up to $100,000 and confinement up to 10 years are potential penalties associated with inappropriate disclosure of CBP data If provided access, you must protect this information from unlawful disclosure! 3 ACE Portal Access: Agency level requirements All agencies that need to access data via ACE portal require an MOU with CBP If your agency does not have an existing MOU with CBP:  Your agency may wait to access the ACE portal until an MOU with CBP is in place  Your agency may request a Letter of Exchange (LOE) with CBP. A sample request for an LOE is available on the Resource Documents page in the Library section of the PGA Resource Center ( Once an MOU or LOE is in place, the next step is to determine if individuals meet the security requirements for ACE access

4 ACE Access: Process for individual ACE access All individuals who access the ACE Portal require an OPM BI (Public Trust Type 25) or equivalent If you believe your clearance level with your agency is the same as, or similar to, the OPM BI, you may apply for access to the ACE Portal.
