Third Amendment Prohibits quartering (housing) soldiers during time of peace They did not want a repeat of what the British had done to the colonists!

Fourth Amendment Based on the right that people and their property should be secure Protection against unreasonable search and seizures Search warrants required – describe place and persons or things to be seized Must have probable cause

Fifth Amendment “I plead the fifth…” Protection of citizen’s rights with regard to crime  Criminal defendants have right to a grand jury trial for an indictment (formal accusation)  Protects an accused person from self- incrimination (having to testify against oneself)  Protects people from double jeopardy  Guarantees due process of law  No property can be taken without just compensation (payment)  Government has the right of eminent domain

Sixth Amendment Right to a speedy, public trial by an impartial jury You have the right to…  Hear the charges against you  Have an attorney  Confront your accusers  Call your own witnesses

Seventh Amendment In civil cases–  A right to trial by jury in certain kinds of cases involving money ($20 or more) or property

Eighth Amendment The court cannot set excessive bail Cruel and unusual punishment is forbidden Death penalty?

Ninth Amendment Some rights are not listed in the Constitution Just because they are not there doesn’t mean you don’t have them…. Right to privacy? Not in the constitution, but you can still claim these rights

Tenth Amendment There are powers that are not specifically given to the federal government  They belong to the states  Or they belong to the people  This means the states can act independently of the federal government -- “Reserved Powers”
