Responsibility for Contractor Training Operator has responsibility for ensuring contractor employees get site-specific hazard awareness training, but operators need not actually provide it. “One way… is to …include this [MSHA safety training requirements] as a provision of the contract. It may also be prudent…to…maintain evidence of independent contractor’s compliance… All other training (new miner, refresher, task, etc.) is contractor’s responsibility, but operators must “ensure” compliance.

Site-Specific Hazard Awareness Training Must give before person exposed to hazards Training includes hazards and emergency procedures Wide latitude in method of instruction One exception

Records of Training Miner gets certified copy after completion of –new miner training –newly hired experienced miner training –refresher training –site-specific hazard awareness training –for task training, after 12 months or upon miner’s request

Compensation Conduct training during normal working hours Normal rate of pay If training given elsewhere than normal place of work, operator must compensate for additional costs: mileage, meals, lodging, etc.
