Driver Disqualification Training

Major Offenses CMV and Non-CMV A CDL holder is disqualified from driving a CMV if convicted of any of the following major offenses while operating any type of vehicle 1a

Major Offenses CMV and Non-CMV Being under the influence of alcohol as prescribed by state law Being under the influence of a controlled substance Refusing to take an alcohol test as requested by a state or jurisdiction under its implied consent laws or regulations 1b

Major Offenses CMV and Non-CMV Leaving the scene of an accident Using a vehicle to commit a felony Using a vehicle in the commission of a felony involving the manufacturing, distributing, or dispensing of a controlled substance 1c

Major Offenses CMV A CDL holder is disqualified from driving a CMV if convicted of any of the following major offenses while operating a CMV 2a

Major Offenses CMV Having an alcohol concentration of 0.04 or greater Driving a CMV when, as a result of prior violations committed operating a CMV, the driver's commercial driver’s license (CDL) is revoked, suspended, or cancelled, or the driver is disqualified from operating a CMV Causing a fatality through the negligent operation of a CMV 2b

Serious Traffic Violations CMV A CDL holder is disqualified from driving a CMV if convicted of any combination of two or more of the following serious traffic violations while operating a CMV 5a

Serious Traffic Violations CMV Driving a CMV without obtaining a CDL Driving a CMV without a CDL in the driver's possession Driving a CMV without the proper class of CDL and/or endorsements for the specific vehicle group being operated or for the passengers or type of cargo being transported 5b

Serious Traffic Violations Disqualification Period* Two convictions in 3 year period = 60 days Three convictions in 3 year period = 120 days 6a *Note: Convictions while operating a non-CMV disqualify driver only if convictions result in revocation, cancellation, or suspension of driver’s license or driving privileges
