– Summary ( Simplified M&A transfer policy) 1.States clearly that ARIN will consider transfer requests that have proper documentation either at the time of merger or acquisition or anytime thereafter 2.Clarifies that unused space is to be returned to ARIN

– Status at other RIRs ( Simplified M&A transfer policy) Draft policy is unique to ARIN Current policy: Other RIRs have merger and acquisition policies

– Staff Assessment Legal: Liability Risk? No Staff Comments: Issues/Concerns? 1.Clarifies that 8.3 transfers (those to specified recipients) are independent of 8.2 transfers. Clearly states that ARIN will consider transfers after the actual M&A has occurred as long as the proper documentation is supplied. 2.Experience with M&A transfers shows that when we ask for detailed utilization information and/or ask for unused or under-utilized address space back, many organizations simply abandon their transfers. Yes Implementation: Resource Impact? Many transfer requests have unused or underutilized space. Audits and follow up activity are labor intensive, could require additional staff.
