When contacted by a Private Facility, Districts should:  Verify their participation in the eligibility determination process  Verify their ability to provide a FAPE (Free Appropriate Public Education) to the student

Eligibility Determination of Eligibility should be on District’s Form  DHS – District of Residence  Parent Placed/Parent Medicaid – –if the student was ruled eligible prior to the parent placing them in the Private Facility, then use the District of Residency –if the student was ruled eligible after the parent placed them in the Private Facility as part of Child Find, then use the District where facility is located April Mississippi Department of Education Office of Instructional Enhancement and Internal Operations/Office of Special Education

Proportionate Share April 2011 Mississippi Department of Education Office of Instructional Enhancement and Internal Operations/Office of Special Education Definition of parentally-placed private school children with disabilities Parentally-placed private school children with disabilities means children with disabilities enrolled by their parents in private, including religious, schools or facilities that meet the definition of elementary school or secondary school.

Proportionate Share (b) Proportionate share of funds. The determination of the proportionate share of federal funds available to serve parentally-placed private school children with disabilities under (b) (Expenditures), including the determination of how the proportionate share of those funds was calculated. Proportionate Share Secondary school  Secondary school means a nonprofit institutional day or residential school, including a public secondary charter school that provides secondary education, as determined under State law, except that it does not include any education beyond grade twelve (12) Elementary school  Elementary school means a nonprofit institutional day or residential school, including a public elementary charter school that provides elementary education, as determined under Mississippi law. Proportionate Share Equitable services determined (a) No individual right to special education and related services. No parentally-placed private school child with a disability has an individual right to receive some or all of the special education and related services that the child would receive if enrolled in a public school. (b) Decisions. (1) Decisions about the services that will be provided to parentally- placed private school children with disabilities must be made in accordance with paragraph (c) below (Equitable Services Determined) and § (c) (Consultation). (2) The LEA must make the final decisions with respect to the services to be provided to eligible parentally-placed private school children with disabilities. Proportionate Share Child Find should include those Private Facilities within your district that are non-profit and meet the definition for an elementary or secondary school Those students receiving a proportionate share should be included in the District’s December 1 Child Count April 2011 Mississippi Department of Education Office of Instructional Enhancement and Internal Operations/Office of Special Education 22

Proportionate Share For Educable Child Parentally Placed Students, districts must include those students in the proportionate share calculation and consult with the Private Facility to decide if any services will be offered these students April 2011 Mississippi Department of Education Office of Instructional Enhancement and Internal Operations/Office of Special Education 23
