2. An initial 29 item RCC Action Plan was announced in December We are now entering the final months of the initial Action Plan. In recent Canada Gazette and Federal Register consultations, PCO/OIRA received stakeholder submissions representing 160 organizations. Canada and the US are committed to another phase of work and PCO/OIRA are considering input received with Departments. Canada and the US will develop an outline of a forward plan for regulatory cooperation by the Spring, building on progress to date and lessons learned through the implementation of the initial Action Plan. Both governments plan to engage stakeholders in the development of the next phase of work. RCC – The Way Forward

Overview of the initiative The Work Plan consists of four Action Items: 1.Develop a joint regulatory priority list for future development and implementation between Transport Canada and U.S. Coast Guard 2.Align the Canadian definition of Certain Dangerous Cargoes with that of the U.S. 3.Add a reference to Alternative Security Arrangements into the Canadian Marine Transportation Security Regulations 4.Establish protocol between Transport Canada and U.S. Coast Guard for ongoing regulatory alignment in the domain of marine transportation security

Progress update Recent face-to-face consultations: RCC dialogue stakeholder sessions in Washington, D.C. – June 20, 2013 Standing Committee on Marine Security at the Canadian Maritime Advisory Council in Ottawa – November 5, 2013 Bi-National Marine Security Working Group in Halifax, December 10-12, 2013 Late Summer, a Notice titled “Stakeholder Request for Comment, Summer 2013” was published in Canada Gazette and the Federal Register The comment period was extended from October 11, 2013 to November 8, 2013 Comments pertaining to marine security have been received by both RCC Secretariats

Key issues Action Item 1 – Development of a joint regulatory priority list is underway Action Items 2 & 3 –The amendments to the Marine Transportation Security Regulations is anticipated to be published by February 2014 in Canada Gazette, Part II Action Item 4 – The guidelines for marine security regulatory development collaboration have been approved by the co-chairs of the Bi-National Marine Security Working Group

7. Ongoing alignment work Action Item 1 – Work continues to validate and analyze identified regulatory differences between Transport Canada and the U.S. Coast Guard to assess both the severity and impact of non-alignment. A joint initial list of regulatory priorities will be established for future regulatory work. Action Items 2 & 3 – Implementation of the amendments to the Marine Transportation Security Regulations, and continue performing assessment of regulatory alignment. Action Item 4 – Review the initial lists of regulatory priorities identified under Action Item 1 and proceed with the regulatory development process, where necessary, to maximize regulatory harmonization.

Next steps Planned Stakeholder engagements Publication of the amendments to the Canadian Marine Transportation Security Regulations in Canada Gazette, Part II, is anticipated for February 2014 Canadian Marine Advisory Council meeting – Spring 2014 Bi-National Marine Security Working Group – May 2014
