WHAT’S IT ABOUT? For anyone who works with visual images and image management, including academic art and art history librarians, museum professionals, archivists, and visual resource collection managers Three main parts Intellectual Property Rights (IPR or copyright law) Metadata Digital Imaging Training

IPR & FAIR USE Understanding Fair Use “ Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as critiscism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular cas is a fair use the factors to be considered shall include”

FOUR TESTS OF FAIR USE The purpose and character of the use, including whether it’s for educational or commercial use. The nature of the copyrighted work. Is it factual or creative? Creative has stronger protection. The amount and substantiality of the portion to be used in relation to the whole. Are there transformative factors? The effect or impact of the use on the potential market or value of the work.

IT DEPENDS!!!! There is not and will never be definitive yes/no answers to copyright questions. Picture fair use as a sliding scale from yes to no depending on the assessment under the four factors. Even if use clearly falls under fair use standards, an entity’s legal advisors or publishers may require permission. If you are knowledgeable about copyright, you can educate your legal counsel… image management professionals often know more about copyright than attorneys who don’t specialize in it.

METADATA Metadata can be used for cataloging, classification, indexing, and display. Each metadata schema, or system of description, has its own definitions and rules. Use the most widely accepted controlled vocabularies Examples include Dublin Core, VRA Core, CDWA, MODS

EMBEDDED METADATA How does the metadata travel with the image so that we don’t lose it? Embed it by writing it directly into the files. Different kinds Technical – so computers know how to display an image Descriptive – most familiar from cataloging – What is shown? Administrative – where did the image come from and how can we use it?

TYPES OF EMBEDDED METADATA TIFF tags EXIF IPTC XMP and XMP Sidecar files How do you learn to work with these? Experiment with using Bridge (for Adobe Photoshop and Lightroom).

WORKING WITH METADATA FOR IMAGES Baked into tools such as Bridge and Lightroom Find practice opportunities Websites often offer free trials YouTube, Lynda.com, University Computer Labs
