3 Introduction As part of fulfilling its oversight mandate the PSC makes recommendations to departments which seeks improve administrative pracice. The periodic review of the status of recommendations made assists the PSC in improving upon and customising its recommendations, and identifying where adequate follow-up takes place. This presentation is based on the PSC’s six- monthly reports that capture all its recommendations and track progress with their implementation.

4 Classification of Recommendations The PSC has grouped its recommendations into two categories, namely, generic and specific recommendations. Generic Recommendations: apply to the Public Service as a whole and serve an advocacy role on good administration. They are promotional in nature and are not directed to a specific department Example: The development of service standards should be included in departmental workplans so that activities relating to service standards can be appropriately budgeted for The above example applies to all departments and promotes the prioritisation of service standards in the Public Service

5 Classification of Recommendations Specific recommendations: recommendations requiring a specific administrative action, or compliance with or adoption of a specific procedure, policy, guideline, protocol or measure. These recommendations are directed at specific departments Example: Since no evidence or supporting documentation could be found to indicate that the selection committees were appointed and utilised for the filling of these posts, it is recommended that the Department institutes appropriate disciplinary action against the official(s) responsible for this oversight. A Department should either implement or disagree with specific recommendations, furnishing reasons where they disagree. The PSC’s follow up is largely on the implementation of specific recommendations (given that generic recommendations play an advocacy role)

6 Status of the Recommendations Of the 2146 recommendations issued by the PSC since the beginning of 2005, 1783 were specific recommendations and 363 generic. Of the 1783 specific recommendations, the PSC established that 954 of them are being implemented by the departments concerned. The PSC also established that 4 recommendations are not being implemented because the departments concerned did not agree with them. With regard to the remainder of the sepecific recommendations (825), the PSC is still following up with departments to track the status of implementation.

7 Status of the Recommendations However, tracking of the recommendations raises certain challenges –Some recommendations take time to implement as they may have resource implications. (some were issued only as recently as December 2007). –Some of our own monitoring protocols require follow up to be done only after three months.

10 Impact of recommendations The work of the PSC can be assessed on the basis of the influence it exerts on – policy change; and greater compliance with specific rules, but also the values and principles governing public administration. 10

11 Impact of recommendations Work on professional ethics led to inclusion of the Code of Conduct in the Public Service Regulations The PSC developed the Financial Disclosures Framework which has since been taken up as policy The PSC’s work on financial disclosures incrementally led to greater compliance with this regulation. The rate of compliance increased from 65% in 2002/04 to 79% in 2005/06, indicating that regard is being taken by departments of the promotional work of the PSC. 11

12 Impact of recommendations Based on the PSC report on Managing Conflicts of Interest, options have been proposed for a policy framework on Conflicts of Interest. This is currently being considered by the DPSA. The Annual Reports of the PSC on Financial Misconduct: In the 2004/05 financial year, 5 national departments and 13 provincial departments failed to submit any report by the due date. In the 2005/06 financial year in comparison, all national departments submitted reports and only one provincial department failed to submit by the due date. 12

13 Impact of recommendations Certain changes were effected on Persal Fields following recommendations the PSC made on the management of sick leave Other examples where the PSC believes its work will lead to greater compliance are: –Improving the quality of performance agreements submitted by heads of department –the process for the evaluation of the performance of Heads of Departments –Ensuring greater accountability in the granting of performance rewards as a result of the PSC’s ongoing monitoring of the procedures 13

14 Way Forward The PSC recognises that evidence on the impact of its work should in future be collected much more systematically. The PSC intends issuing better protocols for communicating with and obtaining feedback from departments on the implementation of recommendations. It will seek more opportunities to engage with stakeholders at an early stage of evaluations or investigations, as well as on final reports and recommendations. It will draw the attention of the Executing Authority/ Head of Department to the specific recommendations that the department is expected to implement.

15 Way Forward It will direct the Executing Authority/ Head of Department to, within a specific period, report back to the PSC on whether the department has implemented the recommendations or not, and if not, to furnish the PSC with reasons for not implementing the recommendations. The PSC relies on the persuasiveness of its analyses to convince executing authorities and heads of department to implement its recommendations. However, in those instances where the recommendations are not implemented and no valid reasons are provided, the PSC will inform the Portfolio Committee accordingly.

16 Way Forward The PSC is only engaged by the Portfolio Committee on Public Service and Administration, the Select Committee on Local Government and Administration and occasionally by the Standing Committee on Public Accounts. Other portfolio committees should also use the work of the PSC more actively. Interaction with provincial legislatures is not at the level which the PSC would like it to be. The PSC therefore recommends that, in consultation with the Portfolio Committee on Public Service and Administration and selected committees of provincial legislatures, a detailed guideline be developed on how committees of parliament or the provincial legislatures should deal with recommendations of the PSC.

17 Conclusion The practice of monitoring and evaluation is generally regarded as an important part of accounting for performance and learning from experience. For the PSC, a large part of such a practice lies in the tracking of the implementation of its recommendations. The PSC has started a process of strengthening its tracking mechanisms and will continue to do s in order to enhance the effectiveness of its oversight work.
