Why legislation is not enough… Relevant legislation in Victoria: Transport Integration Act 2010 – Social and economic inclusion Disability Discrimination Act 1992 – Eliminate discrimination on grounds of disability – Equal rights before the law – Promote recognition and acceptance Disability Standard for Accessible Public Transport 2002 – Improve access for people with a disability Equal Opportunity Act 2010 – People are treated equally; positive burden

Why legislation is not enough… Benefits: Establishes requirements Provides people with a process to challenge actions/inaction Issues: Open to interpretation Inconsistent application Compliance focused

Status: Post Upgrade Issue: Has this upgrade improved accessibility? Really? Really Really? Why legislation is not enough…

Issue: Typical regional/rural stop, note absence of pavement, drainage ditch and nearby trees. Implications for upgrade – expensive, with little accessibility benefits. Why legislation is not enough…

Issues: Everything. Notice: stop located on steep grade, no pavement, no crossing point. Why legislation is not enough…

Status: Post Upgrade Issue: Nice stop. How do you get to it? How does the bus get to it? Why legislation is not enough…

Scenario: Two sets of closely spaced stops Logic: 400m catchment of stop means closely located stops need not be upgraded. Passengers may reach an accessible stop within 5 minutes walk. Upgrade Stop Do Not Upgrade Stop Why legislation is not enough…

So what is policy? Good policy defines success and explains why an outcome is desirable. It guides how decisions should be made which improves consistency and reliability in achieving outcomes; And means that few decisions are left to individuals.
