Urban Programs

Urban Programs - ESC Virginia Erosion and Sediment Control (ESC) Law –Approved in –Title 10 of the Code of Virginia. “Each District in the Commonwealth shall adopt and administer an erosion and sediment control program for any area within the District for which a county, city, or town does not have an approved Erosion and Sediment Control program.” Code of Virginia Title 10.1, Chapter 5 (Section ). –State Program administered by VA DCR. –Localities required to develop ESC Ordinance.

Urban Programs - ESC –District MAY be asked to perform the following ESC duties: Provide plan review services & Board designated as Plan Review Authority. Provide on-site inspection services. Enforce compliance. Administer the entire program.

Urban Programs - ESC Program Goal = Control erosion, sedimentation, and non-ag. runoff from land-disturbing activities. What is an ESC Plan? –Consists of Narrative & Illustrative Maps –Include Criteria, Techniques, & Policies that must be followed to prevent erosion and sedimentation from construction sites. –State Law: > 10,000 sq. ft, but some localities stricter. –Exemptions

Urban Programs - SWMP Storm Water Management Permit Program –EPA Clean Water Act. –Urban storm water is considered a Point Source Pollutant. –Regulated through National Pollution Discharge Elimination System (NPDES) Program. –Includes municipal separate storm water sewer systems & storm water from construction sites.

Urban Programs - SWMP What is a SWMP? –Permit based on an EPA general permit. –Requires development & implementation of a Storm Water Pollution Prevention Plan (SWPPP) –Incorporates Erosion and Sediment Control Plan & similar plans. –Whether or not a permit is required depends on location. > 2500 sq. ft. for Chesapeake Bay Act Areas > 1 acre for remainder of state

Urban Programs - VASMP VA Stormwater Management Pollution Permit (VSMP) –VA authorized to run own permit program. –Prior to 2005 = VA DEQ lead agency. –January 2005 = VA DCR lead agency. –Currently implemented at state level. –Future role for localities. For more information on VSMP refer to:
