Congress shall make no religion, or prohibiting law respecting an establishment of the free exercise thereof; abridging the freedom of speech, or of the press… The First Amendment to the U.S. Constitution  Privileges and protections for journalistic activities.  Access to government operations and records. Rights fall into two main categories:

 Fair report privilege  Allows journalists to report anything said in official government proceedings.  Must be accurate and fair. Privilege and protection for sources and stories  Opinion privilege Protects written opinions from libel suits. Distinction between facts and opinion.

 Allows journalists to criticize performers, politicians and other matters of public interest. Privilege and protection…  Fair comment and criticism  Freedom from newsroom searches  Shield laws

 Are bloggers entitled to the same rights and protections as mainstream media reporters? A final question

Student press law: Tinker Des Moines, IA, December 14,1965—John (15), Mary Beth (13, Hope (11), and Paul (8) decided to wear black armbands in protest of the Vietnam War and supporting the Christmas Truce called for by Senator Robert Kennedy. The principal(s) found out and created a policy that students were to remove the armbands, or face suspension. John and Mary Beth were suspended for 17 days – the length of their scheduled protest. The parents sued after the Iowa Civil Liberties Union approached the family. The case went all the way to the Supreme Court on November 12, 1968.

Student press law: Tinker In a 7-2 decision, the Supreme Court held that the First Amendment applied to public schools, and that administrators would have to demonstrate constitutionally valid reason for any specific regulation of speech in the classroom. "It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate. ” – Justice Abe Fortas

Student press law: Hazelwood The Spectrum, a student newspaper in Missouri, wrote an article about teen pregnancy containing interviews with three students who had been pregnant. References to sex and birth control were considered inappropriate for younger students at school. A second story, about divorce, featured an interview with a student whose parents were divorced. The principal was concerned that too much information was being given about the family without giving them the opportunity to respond (fair comment). The principal cut the pages without informing the publication. The students found out when they got the paper.

Student press law: Hazelwood In a 5-3 ruling, the Supreme Court ruled that school- sponsored activities, including student newspapers and drama productions are not normally protected from administrative censorship by the First Amendment. The decision overrode the precedent set in the Tinker case. Schools who practice open forum, Hazelwood does not apply.

Student press law: Hazelwood People on both sides of the Hazelwood controversy agree that the responsibility of student journalists is unchanged. The emphasis must remain on accuracy, fairness, objectivity, balance, good taste, good judgment, and good sense.

 Public colleges  Student editors are entitled to control the content. Student press law: How much can a school administrator censor?  Public high schools Some guidelines, but lots of gray area.

Student press law: How much can a school administrator censor?  Private colleges and high schools Administrator can act like any other publisher in controlling what’s printed.

Ethical pitfalls  Deception Lying or misrepresenting yourself to obtain information.  Conflict of interest Accepting gifts or favors from sources or promoting social and political causes.

Ethical pitfalls  Bias Slanting a story by manipulating facts to sway opinions.  Fabrication Manufacturing quotes or imaginary sources or writing anything you know to be untrue.

Ethical pitfalls  Theft Obtaining information unlawfully or without a source’s permission.  Burning a source Deceiving or betraying the confidence of a source.  Plagiarism Passing off someone else’s words or ideas as your own.

 When you face an ethical dilemma:  What purpose does it serve to print this?  Who gains?  Who loses?  Is it worth it?  What best serves the readers? Reporters, editors maintain high standard of professional behavior

 Seek truth and report it.  Minimize harm.  Act independently.  Be accountable. Code of ethics Do they love us? 62% of Americans say they don’t trust the press. 59% think newspapers care more about profits than public interests. 58% don’t think reporters care about inaccuracies.
