 The frog festival committee decided that age identification to purchase alcohol wasn't necessary for the one day of the festival.  Michael, Yvonne, Steve, and Jodi are all underage and purchase beer multiple times throughout the day.  They drove up to the other side of the lake to drink some more.  They saw a cabin that was empty.  Yvonne cut her foot and they decided to break into the cabin to look for band aids.  They drank wine coolers they found in the fridge of the cabin.  Michael threw a pillow at Steve and knocked over a lamp.  Steve took a couch cushion and they it back, knocking into a bookshelf causing books and pictures to fall.  Steve threw another cushion knocking over another lamp.

 Jodi threw a clock at Steve.  Yvonne threw a pan, and eventually everyone was throwing everything, trashing the entire house.  There were broken lamps, glass, pictures, and books.  Steve threw up in several places in the living room.  3 days later; the owners of the cabin come home and call the police  Each teenager had to pay $400 and have 80 hours of community service. They were charged with breaking and entering, vandalism, and underage drinking.

 The owners of the vandalized cabin decided to sue the festival committee because they allowed the minors to illegally purchase the beer and get drunk.  The court is being asked to decide whether or not the committee is held responsible for the damages made by the 4 students.

 Any state USA- subdivision 2: providing and purchasing  Says that it is illegal to sell, give, or provide alcohol to anyone under the age of 21. Civil damages act: property damage  Says that the person who suffered the property damage can sue the person who caused the intoxication based on an illegal sale of alcohol.

 Case Law 2: Hacker v.Anytown American Legion  The seller is liable for the resulting damages, if it contributed to the damage.  The committee allowed the minors to have beer sold the them, therefore they are responsible for he resulting damages.  The minors shouldn’t have bought the alcohol, but if the committee had enforced the rules making the beers stands ID everyone, the minors wouldn’t have been able to buy the beer, get drunk, and vandalize the Browns’ cabin.
