Mitigated Statutory Rape

This is the crime committed when unlawful sexual contact occurs between an offender and victim between the ages of 13 and 18.

Sexual battery by an authority figure

Unlawful sexual contact of victims less than 13 years of age is defined by the state of Tennessee as this crime.

Aggravated sexual battery

The unlawful penetration of a victim who is at least thirteen(13) but less than fifteen (15) years of age and the defendant is at least four (4) years but less than ten (10) years older than the victim OR when the victim is at least fifteen (15) but less than eighteen (18) years of age and the defendant is more than five (5) but less than ten (10) years older than the victim is considered to be this type of rape.

Statutory Rape

Sexual penetration of a victim by the defendant when the victim is at least thirteen (13) but less than eighteen (18) years of age and the defendant is at least ten (10) years older than the victim.

Aggravated statutory rape

The person alleged to have been subjected to criminal sexual conduct and can include the spouse of the defendant is this.

The victim

Touching of victim’s intimate parts or clothing covering intimate parts with intent is considered to be this.

Sexual contact

Genital area, groin, inner thigh, buttock, or breast are considered to be these.

Intimate parts

A person who is asleep, unconscious, or physically or verbally unable meets this definition.

Physically helpless

Cut, abrasion, bruise, burn, disfigurement, physical pain, and temporary illness or impairment, including mental faculty, but not emotional distress are all examples of this term.

Bodily injury

If the defendant commits unlawful sexual contact through the use of a weapon, it is defined by the state of Tennessee as being this criminal act.

Aggravated Sexual Battery

This is the crime that occurs when a defendant has unlawful sexual contact with a person through the aid of one or more addition people.

Sexual contact that is committed through the utilization of fraud is defined in Tennessee statutes as this.

Sexual batter

The following is an example of what type of crime: Sexual contact between two people where one person has a “buzz” due to drinking alcohol.

This is not a crime. In order to be a crime, the victim has to be mentally incapacitated.

The following is an example of this: A woman who is mentally deficient due to mental retardation has sexual conduct through the actions of a male in a position of trust.

Sexual battery

Any person who has been convicted in this state of committing a non-violent sexual offense is labeled as this.

Sexual offender

This type of offender is required to register on offender registries for life.

Violent sexual offender

Sexual offenders are required to register for at least this length of time.

10 years

If sexual offender has not been convicted of any additional sexual offenses during the ten year period, and has substantially complied with the registration requirements this shall occur.

The TBI shall remove the offender’s name from the Sex Offender Registry and shall notify the offender that he/she is no longer required to register.

Name two of the three types of information that both sexual offenders and violent sexual offenders are required to report in person if changed between reporting dates.

Their address, employment status, or school information between reporting dates

In a statutory rape, if the defendant is at least this many years older than the victim, it is considered aggravated statutory rape.

10 years

This crime occurs when there is unlawful sexual penetration combined with a mentally deficient victim and the defendant being aided or abetted by one or more other people.

Aggravated Rape

If a victim is under this age, the act of sexual battery becomes aggravated sexual battery regardless of any other circumstances.

If there is more than one of these that make a rape possible while force or coercion is being utilized, the act is now considered aggravated rape.

Offenders or defendants

If this is inflicted on a victim through the perpetration of a rape, the rape is now considered by state law to be aggravated rape.

For defendants of these crimes, an HIV Test will be conducted by licensed medical laboratory, and results given to victim immediately. If an assailant tests HIV+, this may be considered an enhancement factor during sentencing.
