Forfeiture and Pretrial Diversion Centers

Forfeiture Refers to the process by which the government seizes property gained from or used in criminal activity

Example If a person is convicted of smuggling cocaine into the United States from South America a judge can order seizure of the boat from which it was obtained + =

Real Life In the supreme court case Bennis v. Michigan (1996) it was ruled that a persons home or car could be forfeited even if the unaware it was connected to illegal activity

What happens Next After property is forfeited the government has several options 1. Sell the property (money will go the go to the state and federal government)] 2. Keep for use for crime fighting 3. Award to a third party

Pretrial Diversion Centers An alternative to a trial Offered by the judge or prosecution\ Offender agrees to participate in specified counseling or a treatment center in return for withdrawal of the charges
