Every person has constitutional rights 4 th Amendment – “ The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause ….” If a one gives consent to a search, a warrant is not required. If an officer is lawfully present, he may seize objects that are found in "plain view". But, the officer must have had probable cause to believe that the objects are contraband.. 5 th Amendment - The Right Not to Incriminate Oneself (also called, the “right to remain silent” and refuse to answer) The Right To Consult A Lawyer
