June Series Question One – European Law and Statutory Interpretation Many candidates omitted part (a) completely. General answers only were given with basic definitions. In part (b) very few candidates made reference to the purposive approach. There was also a lack of supporting case law in general. Candidates should apply all rules.
June Series Question Two - Magistrates This was a popular question. In (a) answers were generally strong. In (b) candidates tended to ignore the structured training programme, the use of mentors, training sessions, appraisals and the core and developmental training.
June Series Question Three – Judicial precedent In (a) candidates tended to focus on avoidance techniques in general rather than the Practice Statement Part (b) was poorly answered with few candidates citing Young as the leading case.
June Series Question Four – Delegated legislation This was a popular question which was overall well answered. Only the strongest candidates used the data to support their evaluation of delegated legislation.
