Please answer the following question in complete sentences in your notebook. What is a contract? What happens if one person does not hold up their end of the contract?

Students will be able to explain the key elements of a civil case BY  Reviewing key civil court topics  Creating a contract with a partner  Creating a civil case.

A car company can avoid bad publicity by doing this, which ends a lawsuit before it goes to trial. Out-of-Court Settlement

What do you call a person who is accused of wrong- doing in a civil trial? Defendant This is totally your fault. I’m totally suing you.

This person oversees a court of law and can make decisions that influence the outcome of a trial. JUDGE

This is the “standard of proof” in a civil trial, where whoever has the most convincing evidence wins. Preponderance of Evidence

Plaintiff This is the person who feels that they’ve been wronged by someone else. That coffee lid is faulty! I burned my thumb!

This means that someone is responsible by law. Liable Ahhh! Faulty handrail!

 Plaintiff and Prosecutor?  Plea Bargain and Out-of-Court Settlement?  Guilty and Liable?  Beyond a Reasonable Doubt and Preponderance of Evidence?

 With a partner, create a lease (legal rental agreement).  You will have to determine: 1. What was the name of the Owner? 2. What was the name of the Resident? 3. What is the building’s address? 4. How much is the Owner charging? 5. What day of the month does the Resident have to pay it? 6. What will happen if the Resident does not pay their rent on time?

 Determine which part of the contract is being broken and who’s breaking it.  Explain how the plaintiff is being harmed by this breach of contract.

 Determine how you can settle the Conflict.  Will you agree to an Out-of-Court Settlement? What will the terms be?  Will you take the lawsuit to court? What will you ask for? How will you prove your case?

 Each of the project is worth up to 50 total points. Chose one of the three options on the menu.  Create a SHORT STORY or  Create a MOVIE SCRIPT or  Create a COMIC STRIP
