Introduction Domestic Violence Station Audits, cell inspections and Awareness Campaigns

NO. DATE OF AUDIT STATIONNATURE OF AUDIT FINDINGSRECOMMENDATIONS 1.13 May 2008 PROTEA GLEN DVA AUDIT AND CELL INSPECTION The Station was recommended with regards to keeping of records that was according to prescripts except that the station did not have copies of DVA warrant of arrest file. CELL INSPECTION The overall cell conditions were clean. Of concern was that two detainees who were arrested on the 12 May 2008, at 12h00 (Walter Modisane and Siphamandla Thwala) had complained of not having had a bath since their arrest and the inspection was done at approximately 15h15. the cell had no toilet paper and soap, they also indicated that they were not supplied with same since their arrest. The concern was raised with the members manning cells on the day in question and recommendations were made that this be attended to They were requested to indicate what steps the envisaged implementing or had already implemented to remedy the mentioned shortcomings Station Audit and Cell Inspection Proactive Oversight

2.04 June 2008SILVERTON DVA AUDIT AND CELL INSPECTION The Station was commended with regards to keeping of records that was according to prescripts except that the office did not have a register for cases of non-compliance against members. CELL INSPECTION The overall cell condition was clean. Of concern was that there was no toilet paper and soap for the detainee in cell 5. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings 3.04 June 2008EERSTERUSTDVA AUDIT AND CELL INSPECTION A copy of the Domestic Violence Act, the National Instruction, List of Service Providers, and Station Order were not available at the CSC; There is cross referencing with regards to entries in the 508(a) and (b) register but there is sketchy information in the Occurrence book; Copies of 508(a) forms were seen but were not all filed; There were copies of Protection orders but were not filed; There were no DVA warrant of arrests file; There was no file of Non-compliance cases Against members kept; They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

There were no records of non- compliance against members as they cited that they have not received any complaints. CELL INSPECTION The overall cell conditions were clean. Of concern was that there was no toilet paper and soap for the detainees. It is recommended that the exposed burglar doors and windows be covered with wire-mash to avoid them being used for hangings. Kindly advise what steps you envisage implementing to remedy the mentioned shortcomings June 2008MAMELODI DVA AUDIT AND CELL INSPECTION A copy of the Domestic Violence Act, List of Service Providers, the 508(a) incident forms and the 508 (b) register were available at the CSC; The National Instruction and the Station Order were not available at the CSC; There is cross referencing with regards to entries in the 508(a), 508 (b) register and the but columns in the 508(b) are not fully completed and are left for Const Ledwaba to complete; The Protection orders and DVA warrant of arrests file were not available at the CSC; There was no file of Non-compliance cases against members that is kept; They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

CELL INSPECTION The overall cell conditions were clean. Of concern was that there was no toilet paper and soap for the detainees in cell no 2 and 4. It is recommended that the exposed burglar doors and windows be covered with wire-mash to avoid them being used for hangings June 2008HAMMANSKRAA L DVA AUDIT AND CELL INSPECTION The station was commended with regards to keeping of records that was according to prescripts except that the office did not have a register for cases of non-compliance against members. CELL INSPECTION Overall cell conditions were clean and there was warm water in showers. 27 Illegal immigrants found, which 13 of them were there for four days already although arrangements had already been done with immigration for their finger prints to be taken. The kitchen was clean and the menu was good for human’s consumption. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings June 2008HEIDELBERG DVA AUDIT AND CELL INSPECTION The station was commended with regards to keeping of records that was according to prescripts except that the office did not have a register for cases of non-compliance against members. CELL INSPECTION Cells found in a clean state; Suspect found with bruises on the face after suffering an assault by his employer and not been referred to the hospital. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

7. 17 June 2008DAWN PARK DVA AUDIT AND CELL INSPECTION The station was commended with regards to keeping of records that was according to prescripts. To keep up the good work! June 2008LOATE DVA AUDIT AND CELL INSPECTION SAPS 508(a) incidents file is kept but not updated. Responses to DVA are not all recorded on the forms and some columns of the form are incorrectly completed. SAPS 508 (b) is completed properly though serial numbers of protection orders are not entered in the relevant columns. There is no follow-up on protection orders that are outstanding for complainants that have been sent to court to apply for protection orders. There is no updated list of service providers in the CSC. A register of complaints against member’s i.t.o non-compliance to DVA kept but not updated. There are no copies of DVA, station orders i.t.o DVA and operational plan. CELL INSPECTION The cells are dirty particularly no 2 and 11. Prisoners were properly categorized though illegal immigrants Sam Shoma, Karim Moreduma and Jimmy Ndlovu have been in the cells for over a week. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

9. 19 June 2008KAMEELDRIFT DOMESTIC VIOLENCE AUDIT SAPS 508(a) incidents file is kept but not updated. Responses to DVA are not all recorded on the forms and some columns of the form are incorrectly completed. Female members not assigned on each shift; Members not trained on DV handling; DV Act not found in the CSC or anywhere in the station; CELL INSPECTION Cells found in good order except for the shower which had no warm water They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings June 2008MAGALIESBURG DVA AUDIT AND CELL INSPECTION The office commended the station with regard to keeping of records that was according to prescripts except that there were no copies of warrants of arrests. Ensure that copy of updated service providers list is in each of the operational vehicle. CELL INSPECTION The overall cell conditions were clean, except that one toilet which housed two detainees was not flushing. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings June 2008NIGEL DVA AUDIT AND CELL INSPECTION Service Provider’s list and Station Orders found in order; List of Service Providers available in both the CSC and vehicles; Monthly procedures of File 39/4/2/3 on DV incidents maintained: SAPS 10 () on DV thoroughly maintained; Female members assigned on each shift; DV Act 116 of 1998, found in the CSC and in vehicles used by officials; They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

Station Orders updated; Protection Orders and Warrants of arrest well maintained; Victim Empowerment Centre impressive; CELL INSPECTION Cells clean; No hot water in the cell showers June 2008VOSLOORUS DVA AUDIT AND CELL INSPECTION Copies of the Domestic Violence Act, List of Service Providers (to be updated), 508(a) incident forms and the 508 (b) register were available at the CSC but the latter was not completed properly; The National Instruction and the Station Order were not available at the CSC; There is no cross referencing with regards to entries in the 508(a), 508 (b) register and the ;The Protection orders and DVA warrant of arrests file were not available at the CSC; There was no file of Non-compliance cases against members kept; There were no records of non-compliance against members as they cited that they have not received any complaints. There were female officers on the shift on the day in question. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

CELL INSPECTION The overall cell conditions were not clean. Of concern was that there were shower and other blockages in the cells. It is recommended that the exposed burglar doors and windows be covered with wire- mash to avoid them being used for hangings. There were no juveniles and illegal immigrants in detention on the day in question August 2008JEPPE DVA AUDIT AND CELL INSPECTION This office complemented station with regards to keeping of records that was according to prescripts. CELL INSPECTIONS Cells clean No hot water in the cell showers No tissue found in some cells No soap and tissue found in cell 20 They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings Sept 2008DUNNOTAR DVA AUDIT AND CELL INSPECTION There was no copy of the Domestic Violence Act readily available at the CSC; There was a copy of the National Instruction, list of service provider, readily available at the CSC; The 508(b) is not completed properly; There is cross referencing with regards to entries in the 508(b) register and the They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

September 2008 KEMPTON PARK DVA AUDIT AND CELL INSPECTION This office complemented station with regards to keeping of records that was according to prescripts. Of concern is that your station did not have a file of copies for DVA warrants of arrest and a Victim friendly facility. CELL INSPECTIONS Overall cell conditions were clean but there were blocked drains. No juveniles were found. The problem of illegal immigrants still persists as on the day in question the members cited that these illegal immigrants are brought in by the Department of Home Affairs and the police do not know what to do with them. Their detention is contrary to the provisions of the Immigration Act. Food prepared was per menu and good for human consumption. We would nevertheless like to send our appreciation for the attitude of the officials and their eagerness to assist us with these audits. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings September 2008 EVATON DVA AUDIT AND CELL INSPECTION This office complemented station with regards to keeping of records that was according to prescripts. Of concern is that there is confusion with regards to the completion of the 508(a) incident forms. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

September 2008 NORKEM PARK DVA AUDIT AND CELL INSPECTION There were copies of the Domestic Violence Act, List of Service Providers, and 508(a) copies were readily available at the CSC; There was a copy of the National Instruction readily available at the CSC; The 508(b) is not completed properly; There is cross referencing with regards to entries in the 508(b) register and the Occurrence book; There were copies of Protection order and No DVA warrant of arrests filed; There was no file (39/4/3/1) of Non- compliance cases against members kept; There were no copies of Protection orders still to be served. There was a female member assigned on the shift on the day in question. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings September 2008 SEBOKENG DVA AUDIT AND CELL INSPECTION This office complemented station with regards to keeping of records that was according to prescripts. Of concern is that there is confusion with regards to the completion of the 508(a) incident forms. CELL INSPECTIONS Overall cell conditions were clean except two which had burst pipes with water running down the court yard. No juveniles and illegal immigrants were found. One 72 year old was arrested for corruption and still not charged on the day in question. The kitchen was clean. Food prepared was not per menu and not good for human consumption. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

November 2008 DOUGLASDALE DOMESTIC VIOLENCE AUDIT This office complemented station with regards to keeping of records that was according to prescripts. Of concern was the confusion with regards to the completion of the back part of the 508(a) form which was explained to the assisting member We would nevertheless like to send our appreciation for the attitude of these officials, Capt Naidoo and Supt Kruger in their eagerness to assist us with these audits. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings November 2008 HONEYDEW DOMESTIC VIOLENCE AUDIT This office complemented station with regards to keeping of records that was according to prescripts. Of concern is that your Domestic Violence Act is a draft copy and confusion with regards to the completion of the back part of the 508(a) form which was explained to the assisting member. We would nevertheless like to send our appreciation for the attitude of Supt Mavundza in his eagerness to assist us with these audits. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcoming November 2008 ROODEPOORT DVA AUDIT AND CELL INSPECTION This office complemented station with regards to keeping of records that was according to prescripts. Of concern was the confusion with regards to the completion of the back part of the 508(a) form which was explained to the assisting member. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

CELL INSPECTIONS Overall cell conditions were clean but there were no toilet papers and soap for detainees who were arrested on the 10 November 2008 and did not have these on the visitation day. We would nevertheless like to send our appreciation for the attitude of these officials, Capt Rasserchun in his eagerness to assist us with these audits November 2008 JHB CENTRAL DVA AUDIT AND CELL INSPECTION The copies of the Domestic Violence Act, List of Service Providers, Station order were readily available at the CSC; There was no copy of the National Instruction at the CSC; The 508(b) is not completed properly ; There is cross referencing with regards to entries in the 508(b) register and the Occurrence book; The copies of Protection order and DVA warrant of arrests were not perused as the Responsible member had already left: There was no file (39/4/3/1) of Non- compliance cases against members kept; There were female members assigned on The shift on the day in question. Of concern is that there is confusion with regards to the completion of the back of the 508(a) incident forms. CELL INSPECTIONS The overall cell conditions on the 1 st and 3 rd floors were dirty and had no toilet papers for detainees. The condition of the 2 nd floor cells was clean They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

The cells occupying Booysens detainees were in a bad state, and the members manning these cells indicated that there is a problem with the stations providing them with amenities November 2008 GALLOR MANOR DOMESTIC VIOLENCE AUDIT Nothing was found regarding Domestic Violence records, it is alleged that victims are transferred to the main station for service. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings November 2008 BUCCLEUCH DOMESTIC VIOLENCE AUDIT Nothing was found regarding Domestic Violence records, it is alleged that victims are transferred to the main station for service. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings December 2008 DOBSONVILLE DOMESTIC VIOLENCE AUDIT AND STATION AUDIT This office complemented station with regards to keeping of records that was according to prescripts. Of concern was the confusion with regards to the completion of the back part of the 508(a) form which was explained to the assisting member. CELL INSPECTION There were 3 juveniles found and one had a swollen face from the beatings suffered in the hands of the community members. Cells were clean in both female and male sections. The toilets were in working order and there as warm water in the showers as well. One men’s cell was found overcrowded and it was recommended that some be moved to another cell. There were no tissues and soaps found in all the cells. They were requested to indicate what steps they envisaged implementing or had already implemented to remedy the mentioned shortcomings

CELL INSPECTION There were 3 juveniles found and one had a swollen face from the beatings suffered in the hands of the community members. Cells were clean in both female and male sections. The toilets were in working order and there as warm water in the showers as well. One men’s cell was found overcrowded and it was recommended that some be moved to another cell. SATELITTE There is currently no existing satellite office in Gauteng. The office had identified Vereeniging as the place we can have a satellite office due to high volumes of cases emanating in the area however, due to the budget that was cut this year we have since been informed that the establishment of the satellite office will not be feasible in the coming financial year.
