Two Different Programs 15 USC 3710 (i) Authorizes direct transfers Computers for Learning Program (CFL) Title 40 USC 549 Authorizes transfers approved by GSA to a State Agency for Surplus Property (SASP) for subsequent donation to a school Federal Surplus Personal Property Donation Program [Donation Program]
Authorities Stevenson- Wydler Technology Innovation Act of 1980, as amended (15 U.S.C. 3701) (i) Research equipment The Director of a laboratory, or the head of any Federal agency or department, may loan, lease, or give research equipment that is excess to the needs of the laboratory, agency, or department to an educational institution or nonprofit organization for the conduct of technical and scientific education and research activities. Title of ownership shall transfer with a gift under this section.

What is a non-profit organization? What constitutes “technical and scientific education and research activities”? GSA cannot dictate how other agencies are to implement the SWA authority
What is it? Computers for Learning (CFL) A program whereby educationally useful Federal equipment excessed by Federal agencies is transferred directly to schools and community-based educational organizations [educational non- profit organizations] A website developed by GSA to facilitate the CFL program. Agency participation is voluntary Agencies can elect to transfer their educationally useful equipment to schools on their own without going through the CFL website
Definitions EO12999 “Schools" means individual public or private education institutions encompassing prekindergarten through twelfth grade, as well as public school districts. "Community-based educational organizations" means nonprofit entities that are engaged in collaborative projects with schools or that have education as their primary focus.
Definitions EO12999 “Educationally useful Federal equipment" means computers and related peripheral tools (e.g., printers, modems, routers, and servers), including telecommunications and research equipment, that are appropriate for use in prekindergarten, elementary, middle, or secondary school education.

Schools Public, Private, Parochial School, Home Schools Grades Prekindergarten through 12 Home Schools Must meet state requirements Located in: One of the 50 states District of Columbia U.S. Virgin Islands American Samoa Guam Commonwealth of Puerto Rico Commonwealth of Northern Mariana Islands
Who Is Eligible? Community-based educational organizations Nonprofit Engaged in collaborative projects with schools or education as their primary focus Meet the criteria of an educational organization as defined by the Donation Program
