Support Staff Surplus Staffing  Clauses –  Apply to permanent staff only  Work ceases to exist as a result of restructuring  Restructuring triggered by loss of pupils and /or funding

 One months notice to affected employees  One month is to allow discussion about attrition and alternative positions  Each occupational category can be treated separately

 NZEI suggests that schools conduct a needs analysis similar to that required in cl9A.4(a) of the PTCA.  This would identify the future structure, staffing and financial needs of the school and would be done in consultation with the staff.

 Following needs analysis all positions in each category are internally advertised.  Only permanent staff members can apply and only employees within each category can be appointed.  NZEI suggests that you follow your normal appointment process.

 Staff not appointed must be given one months written notice.  The one month must be a full month at work.  During the month both parties must make reasonable efforts to locate alternative employment.  A reasonable offer of employment is defined in the agreement

 At expiry of notice period if no work has been found the employee is entitled to redundancy pay.  The calculation is: - 6 weeks pay for the first year - 2 weeks pay for each subsequent year - maximum of 30 weeks pay.

 Redundancy includes all holiday pay and wages owing.  A work reference or record of service can be requested.
