Collective redundancy is : When a number of employees are being made redundant within a 30- day period this is known as a collective redundancy.collective redundancy

Collective redundancy refers to the situation were 5 employees in an establishment employing employees. 10 employees in an establishment normally employing employees. 10% of employees in an establishment normally employing employees,or 30 employees in an establishment normally employing 300 or more employees3

The information and consultation process In such a situation, under the Protection of Employment Act your employer is obliged to enter into consultations with a view to agreement with your representatives. This legislation is separate from the Redundancy Payments Acts 1967–2007. These consultations must take place at the earliest opportunity and at least 30 days before the notice of redundancy is given.Protection of Employment Act

Who are employees representatives? ‘Employees’ Representatives’ are defined as: A trade union, staff association or accepted body with which it has been the practice of the employer to conduct collective bargaining negotiations, or In the absence of a trade union etc.. a person or persons chosen by employees from amongst their number to represent them in negotiations with the employer (this is an arrangement put in place by the employer).

The aim of the consultation is to consider whether there are any alternatives to the redundancies. An employer is also obliged to provide the following information in writing to staff representatives: The reasons for the redundancy The number and descriptions of the employees affected The number and descriptions of employees normally employed The period in which the redundancies will happen The criteria for selection of employees for redundancy The method of calculating any redundancy payment. The employer is also obliged to inform the Minister for Jobs, Enterprise and Innovation in writing of the proposed redundancies at least 30 days before the occurrence of the first redundancy.

Copies of all information in relation to the above, supplied to the employees’ representatives, must be sent to the Minister ‘as soon as possible’.

What is the notification to the Minister? No Individual notice of redundancy may issue until at least 30 days after notification of the proposed redundancy has been received by the Minister. Notification should be sent by registered post or by hand. Notification should include the following: Name/address of the employer, stating whether employer is a company, partnership or sole trader. Address of the establishment where the collective redundancies are proposed.

Total number of persons normally employed there. The number/categories of employees whom it proposed to make redundant. The period over which it is proposed to implement the collective redundancies. The reasons for the proposed collective redundancies. Names/addresses of the trade unions/staff associations representing employees affected by the proposed redundancies. Details of the consultations with each trade union (commencement date; progress made etc.)
