Sexual Harassment Electra ISD School Year

What is Sexual Harassment?  Sexual harassment is a form of sex discrimination that violates Title VII of the Civil Rights Act of 1964 as well as state and local laws.  It is UNWELCOME sexual advances, requests for sexual favors, and other physical or verbal conduct of a sexual nature.

Two Types of Sexual Harassment  Quid Pro Quo ~ (Tangible Employment Action) or “something for something”/ “a favor for a favor”  Hostile Environment

We are each responsible for the reasonable perceptions drawn from our own behavior.

QUID PRO QUO (Tangible Employment Action)  This behavior involves express or implied demands for sexual favors in exchange for some benefit (a promotion, a raise, a good grade or recommendation)  Quid pro quo can also be used to avoid some detriment (termination, demotion, or a failing) in the workplace or in the classroom.  Quid pro quo harassment may be as undisguised as a direct solicitation ("sleep with me or else..."). It may take the form of more oblique sexual propositions or dating invitations ("discuss your project over dinner at my house,").  The law does not require a showing that the supervisor actually made good on his or her demands or insinuations to impose liability.

Hostile Work Environment  Sex harassment may also arise from unwanted conduct which is so severe or persistent that it creates an intimidating, hostile, or offensive educational or working environment.  Conduct may be physical, verbal or nonverbal.

Possible Physical Behaviors that are Unwelcomed and Sexual in Nature  Hugging  Kissing  Pinching  Posturing  Patting  Grabbing  Gesturing  Touching  Assault  Starring

What you should do if you are a victim of sexual harassment  It is your responsibility to inform the building principal or assistant principal as soon as possible of the harassment or incident.  While it is NOT your responsibility to stop the harassment, there are a few things that you can do: if you can, make it clear to the harasser that his or her actions or comments are unwelcomeif you can, make it clear to the harasser that his or her actions or comments are unwelcome keep a record of the incidents including description of the unwanted behavior, times, places and witnesseskeep a record of the incidents including description of the unwanted behavior, times, places and witnesses
