Heat Smart Requirements - History Senate Bill 102 ▫Passed by 2009 Oregon Legislature ▫Protect human health from uncontrolled wood smoke 2 Size of Fine Particulate (PM 2.5 )

Heat Smart Program– Main Components Requires removal of old, uncertified stove upon home sale Requires emissions certification for solid fuel burning devices (e.g. EPA-exempt stoves) 3

Heat Smart Program- Uncertified Stove Removal through Home Sale Requirement 4 Went into effect: August 1, 2010 Requires removal of old, uncertified stove upon home sale Includes free-standing woodstove or fireplace insert Includes uncertified stoves in garages, backyard “workshop” Stove must be removed prior to close of sale It is the seller’s responsibility to remove the uncertified woodstove unless: The buyer and seller agree the buyer will be responsible for removing the stove The buyer must remove and destroy the uncertified woodstove within 30 days after the closing date of sale

Heat Smart Program- Uncertified Stove Removal through Home Sale Requirement Uncertified stove must be destroyed (or rendered inoperable) Can be taken to a metal recycler or landfill, hearth products dealer, or even a neighbor who may turn it into a decorative planter Person responsible for destroying stove must obtain a receipt showing proof of destruction Must notify DEQ of removal and destruction 5

How did the Heat Smart Program come about? Longtime woodstove issues in Oregon Local cities and counties began adopting local ordinances requiring removal of uncertified stove at time of home sale ▫Created a patchwork of requirements Worked closely with hearth products, realtors, league of cities 6

Heat Smart - Legislative Proposals 2007 – 1 st version of Heat Smart bill failed 2009 – Passed - managed to get legislative support Key components to success of bill: ▫Noncompliance does not undo home sale ▫Created a uniform statewide disclosure form ▫Relied on experience of communities already implementing these requirements ▫Helped that we instituted program during housing boom 7

Heat Smart Rules- Certification Requirements for Other Residential Wood Heating Devices 8 EPA Exempt Stove Establishes emission standards for a broader range of home wood-heating devices, including: ▫“EPA-exempt” stoves ▫Outdoor wood boilers (hydronic heaters) Devices must be certified under the federal New Source Performance Standard for woodstoves to be sold in Oregon Outdoor Wood Boiler
