Legislative Update Education Bills

2 HB 2374 WVC e –Restricts the use of student social security numbers –Effective July 1, 2003 shall request social security number of each child –If social security numbers are not provided the county board shall assign a 9– digit number as designated by the State Board

3 HB 4022 WVC Establishes a more formal process for awarding grants for schools to implement programs to strengthen student learning ability WVC 18A-2-6a Release time for service personnel to serve in Legislature without loss of benefits

4 HB 4054 WVC 18A-3-3a Shortage areas shall be defined by the State Board Provides for the reimbursement of tuition, registration, and other required fees to teachers seeking certificate renewal or add’l endorsement in a shortage area DOE may pay the moving expenses for a teacher who meets certain criteria

5 HB 4095 WVC 18-5A-6 A school curriculum team established at an elementary or a combination elementary and middle school, when the counselor is not assigned to the school on at least a one-half basis may meet on days when the counselor is not at the school. Requires the principal to consult with the counselor on issues relevant to the meeting agenda

6 HB 4149 WVC a Standardizes procedures to be followed by county boards in conducting public hearings on school consolidation and closure

7 HB 4362 WVC 18B-1A-5 –Expands the powers and duties of the higher education policy commission WVC 18B-2A-5 –Implements policy where college students obtain credit toward graduation for service performed in public schools as tutors, advisors, and mentors

8 HB 4428 WVC : Relates to student transfers between county school systems and where counted in net enrollment: –Transfer requests must be agreed to by both boards –Establishes process for appeal to State Superintendent if both boards do not agree –If student transfers without agreement of both boards or successful appeal, student is to be counted in net enrollment of county of residence

9 HB 4428 continued –Where agreement exists, if student transfers back to school in county of residence after second month, the county of residence may issue invoice to other county board for amount of state aid county would have received, on a pro-rata basis

10 HB 4484 WVC 18-7A-26 –Allows retired members of the teachers retirement system to name a new joint annuitant upon the death of a spouse

11 HB 4507 WVC Enabling school psychologist to practice within the scope of their employment with a permit issued by the State Board

12 HB 4534 WVC 18C-8-1, 2, 3. –Creates Financial Aid Coordinating Council –Purpose is to examine and recommend strategies for maximizing coordination among the various sources of student financial aid

13 HB 4579 WVC 18-7A-13a –Clarifies that a retired public school teacher may be employed as a higher education teacher without loss of benefits –Effective date from enactment to Dec. 31, 2002

14 SB 4 WVC 18A-1-1 Defines alternative education and dangerous student Expands definitions of: alternative education and dangerous student sale of narcotics and possession of deadly weapons and controlled substances on educational premises vehicles and at school sponsored functions assault and battery committed by student

15 SB 4 continued WVC 18A-1-1 –Expands definition of dangerous weapon to include: Knife with a blade of 3 ½ inches or less, and Explosive, chemical, biological, & radiological materials

16 SB 32 WVC 18-9E-3 –Requires the School Building Authority to promulgate rules to establish a process for independent testing of HVACs –Requires training for the maintenance staff –Requires reporting of completed training –Requires plan for continued education –Requires report of certain air quality problems

17 SB 177 WVC –Provides procedures for implementing school dress code for students –Requires State Board to promulgate rules to allow a county board to implement requirements that students wear a school uniform –May be required by the county board for the entire district or for certain schools

18 SB 423 WVC 18-7A-38 –Establishes method for calculating number of days retired teachers work as substitutes: Total # of hours worked Standard # of hours for full-time teacher

19 SB 438 WVC 17B-2A-2 –Requires the Division of Motor Vehicles to develop a system that allows applicants for drivers licenses to register with the selective service system at the same time

20 SB 563 WVC –Requires driver education programs to include a component on motorcycle safety awareness

21 SB 727 WVC 16-5K-6 –Creates birth to age three fund within state treasury

26 SB 247 continued Grants principals: –A 1% increase in the principals’ increment –State increase to be paid to principals in addition to any county increments being paid for principals and assistant principals as of January 1, 2002

27 SB 247 continued Grants service personnel: –$71/month increase in basic salaries –$1/month increase in the experience increment –Increases educational bonus by $1/month –Adds additional educational bonus increments of $11/month for BA+15, MA+15, MA+30, MA+45 and MA+60 –Increases the educational bonus for those with degrees (Associate, Bachelor, Masters, and Doctorate) to $40/month for each degree level
