JACK O’CONNELL State Superintendent of Public Instruction 3 CAHSEE Requirement All students must satisfy the CAHSEE requirement, as well as all other state and local requirements to receive a California public high school diploma. The CAHSEE requirement can be satisfied by passing the exam or, for students with disabilities, receiving a local waiver. Education Code Section 60851(c).

JACK O’CONNELL State Superintendent of Public Instruction 8 Unlisted Variations Education Code, Section 1218 requires the school district to file a request with the CDE for review and approval of proposed examination variations that are not specified in sections 1215, , or Step 1-Verify that the test variation is unlisted by reviewing the Test Variation Matrix or CAHSEE regulations. Step 2-Complete Request for Test Variations form. Step 3-The CDE will convene a panel of experts to review the request. Step 4-The CDE will issue a decision within 15 working days of receipt of the request.

JACK O’CONNELL State Superintendent of Public Instruction 9 Local Waiver Education Code Section 60851(c) At the request of the student’s parent or guardian, a school principal must submit to the local school board a request for a waiver of the requirement to pass the part(s) of the CAHSEE on which a modification was used and the equivalent of a passing score was earned.

JACK O’CONNELL State Superintendent of Public Instruction 10 Local Waiver Process For the local board to waive the CAHSEE requirement, the principal must certify the student has: (1) An Individualized Education Program (IEP) or Section 504 Plan that requires the modifications to be provided to the student when taking the CAHSEE. (2) Completion, or in the process of completion, of high school-level coursework sufficient to have attained the skills and knowledge otherwise needed to pass the CAHSEE. (3) A score report showing that the student received the equivalent of a passing score on the CAHSEE while using a modification.

JACK O’CONNELL State Superintendent of Public Instruction 11 Tentative Settlement Agreement for Courtney Kidd, et al. v. O'Connell, et al. (also known as the Chapman case) Requires an independent external study examining students who: –have taken, but not passed, the CAHSEE with modifications and/or accommodations specified in IEPs or 504 plans. –have satisfied or will satisfy all other requirements for graduation from high school. Does not change current law regarding waivers, nor does it extend the exemption process.

JACK O’CONNELL State Superintendent of Public Instruction 12 Valenzuela Settlement On August 13, 2007, the Alameda County Superior Court approved a settlement in the case of Valenzuela v. O’Connell. Primary terms of settlement: LEAs must provide intensive instruction to students for up to 2 years after completion of grade 12 for the parts of the CAHSEE not yet passed. For English learners, the instruction must also include services to improve English proficiency. The complete text of the settlement agreement and AB 347 are available on the CDE Web site at / /

JACK O’CONNELL State Superintendent of Public Instruction 13 Remediation Education Code Section Districts must provide remediation to students in grades seven through twelve who do not show sufficient progress toward passing the CAHSEE. Education Code Section (Intensive Instruction and Services Grant): –$74.3 million is budgeted statewide. –All LEAs that apply will receive funding after October 1, –LEAs will receive up to $531 for each grade twelve student who has not passed one or both parts of the CAHSEE. –Any remaining funds will be distributed to LEAs for grade eleven students.
