EC300/2008 – common rules civil aviation security EC1254/2009 – derogation from EC300/2008 EC185/2010 – Implementing rules to “harmonise” - EC357/ EC358/ EC573/ EC983/ EC334/2011

The following categories are included per EC 1254/2009: Aircraft with MTOW of less than 10000kgs; Flights with a maximum take off weight of less than 45500kgs for the carriage of own staff and non-fare paying passengers or goods as an aid to the conduct of company business (general business aviation); This is a large category, containing a number of different types of activity, with different levels of risk. They are therefore divided into three parts:

10(a) Company owned aircraft on company business: these flights will be covered by derogations and ASMs will apply. 10(b)Aircraft chartered for company business: the derogation will NOT apply and NASP measures are required(for aircraft with MTOW of more than 10000kgs) 10(c) Fractional aircraft: As charter. 10(b) and (c) – exemptions possible. Where granted it will have a specific start and end time and will relate to a specific route

The onus will be on the air carrier to prove to the FBO or Airport Operator that they have an exemption. Private flights over 45.5 tonnes (currently out) and company owned aircraft over 45.5 tonnes (in) ?? Aircrafts stores / catering (LAGS) / cutlery Sporting goods – weapons Extension of CPRSA at some airports
