2 The Facts Complaint received about a dispensing error Information gathered related to –the error –other errors, and related record keeping

3 Review by the Complaints Committee Dismisses complaint Requests an investigation of the other dispensing errors Reviews the resulting investigation Refers member to discipline

4 Health Professions Procedural Code s.75(c) The Registrar may appoint an investigator to determine whether a member has committed an act of professional misconduct if, the Complaints Committee has received a complaint about the member and had requested the Registrar to conduct an investigation

5 S.26(2) A panel, after investigating a complaint regarding the conduct or actions of a member, considering the submissions of the member … may do any one or more of the following: 1.Refer a specified allegation of professional misconduct or incompetence to the Discipline Committee if the allegation is related to the complaint

6 Appeal Member disciplined Finding –of professional misconduct –appealed –overturned by Court of Appeal Jurisdiction issues –Complaints Committee –Discipline Committee
