Clean Water Act – Why New Regulations 36 years later?  Clean Water Act – 1972 Regulates discharges into Waters of the US Goal – Waters that are Fishable, Swimmable, Navigable  Non-Point Source Pollution – late 1980’s Amendments to the Act – regulation of NPS General Permits for:  Construction  Municipal Separate Storm Sewer (MS4)  Industry TCEQ to Implement  CGP – March 5, 2003  MS4 – August 13, 2007

MS4 Permit Overview  TXR04000 – Phase II MS4 Regulations MS4 – Municipal Separate Storm Sewer System Similar to CGP, a general permit issued Five years to fully implement all Goals for: Six Minimum Control Measures  Public Education  Public Involvement  Illicit Discharge Detection and Elimination  Construction Discharges  Post-Construction Discharges  Municipal Good-Housekeeping

Addressing Construction Discharges  Municipalities must develop, implement and enforce a program that: Includes an ordinance to require erosion and sediment controls as well as sanctions to ensure compliance Requirements for construction sites to:  Implement appropriate control BMPs  Control wastes Develop procedures to:  Review site plans  Receive and consider public input  Inspect and enforce the use of control measures

City of Southlake - Submitting an Erosion and Sediment Control Plan  Any site that disturbs more than an acre or is in a Common Plan of Development disturbing more than an acre The Submittal will include a map:  BMPs for erosion and sediment controls  Waste controls  Other related items, e.g. concrete wash-out Details of BMPs Related documents  Review Required

Southlake cont. - Owner/Operator to Conduct Regular Inspections  Only for those sites required to submit plans for ESC  Same schedule choices as CGP  Report on website program provided by the City of Southlake  Training and/or guidance on using this program to be provided by Southlake

Southlake cont. - Contractors to Attend Pollution Prevention Training  Starting May, 2009  Includes all contractors who register with Building Inspections  Training to be provided by Southlake  Or certificate of acceptable training accepted

Southlake cont. - Final Acceptance of Public Improvements in a Land Development  Requirements for either: Permanent erosion controls Or, maintenance of temporary controls until final or permanent controls are established
