Special Meeting on PP 10 of the 1992 Rio Declaration Bangkok, 26 April 2006 INDONESIA’s PP 10 COMMITMENTS Hoetomo Deputy Minister for Environmental Compliance MINISTRY OF THE ENVIRONMENT REPUBLIC OF INDONESIA

BACKGROUND Why Indonesian Government joins PP 10? Stipulated in Environmental Management Act 1997 (EMA 1997): Article 5 : (1) Every person has the same right to an environment which is good and healthy. (2) Every person has the right to environmental information which is related to environmental management roles. (3) Every person has the right to play a role in the scheme of environmental management in accordance with applicable laws and regulations. Article 6 (2) : Every person who carrying out a business or other activity must provide true and accurate information regarding environmental management. 1

Article 7 (1): The community has the same and the broadest possible opportunity to play a role in environmental management Article 37 (1):The community has the right to bring a class action to court and/or report to law enforcers concerning various environmental problems which inflict losses on the life of the community. Institutional Commitment Minister of the Environment has incorporated the 3 access principle into its program such as: PROPER (Performance Rating Program) and Bangun Praja (Clean and Green City) Program. 2 Why Indonesian Government joins PP 10……….

COMMITMENTS RELATED TO ACCESS TO…. Information : Commitment # Disseminate information by providing environmental information through internet as well as publications And publishing environmental regulation booklets Participation: Comm #, increase public involvement in EIA Process Comm #, promote public participation in the drafting of local environment Regulation by providing Regulation Drafting Guidelines To make possible all of those 3 accesses synergized, the Government, i.e. Ministry of the Environment is now revising the EMA 1997 (Comm # ) Justice: commitment # Increase management of public complaints on environmental cases

NGOs (Indonesian Centre for Environmental Law) : Improving capabilities of local level on the implementation of 3 access Conducting 2 nd National Assessment on the 3 Access Principles 1 2 Legislative: Enhancing cooperation with Members of Parliament to promote improved Good Environmental Governance through the establishment of Environmental Caucus
