POWERGRID NORTHERN REGONAL LOAD DESPATCH CENTRE SUBMISSION IN RESPECT OF PETITION NO. 35/2003 DATED

The clause referred to by the petitioner: (CERC Notification 26 th March 2001 Clause 3.13(xii)) In the event of bottleneck in evacuation of power due to any constraint, outage, failure or limitation in the transmission system, associated switchyard and substations owned by CTU (as certified by RLDC) necessitating reduction in generation, RLDC shall revise the schedules which become effective from 4 th time block, counting the time block in which the bottleneck in evacuation of power has taken place to be the first one. Also during the first, second and third time blocks of such an event, the scheduled generation of the station shall be deemed to have been revised to be equal to the actual generation and also the scheduled drawals of the beneficiaries shall be deemed to have been revised to be equal to their actual drawals.

CERC Notification dated March 26 th 2001 Clause 3.13.vi Based on the requisitions given by the beneficiaries and taking into account technical limitations on varying the generation and also taking into account transmission system constraints, if any, RLDC shall prepare the economically optimal generation schedules and drawl schedules and communicate the same to generator and the beneficiaries. RLDC shall also formulate the procedure for meeting contingencies both in the long run and in the short run (daily scheduling).

CERC Notification dated 26 th March 2001 clause 3.13.xiii In case of any grid disturbance, schedule generation of all the generating stations and schedule drawal of all the beneficiaries shall be deemed to have been revised to be equal to their actual generation/drawal for all the time blocks affected by the grid disturbance. Certification of grid disturbance and its duration shall be done by RLDC.

Chronology of Events RLDC’s instruction issued to Uri HEP formalizing contingent operation mode (copy to NREB Sectt.) 29 th April 2003 SEM data with specific instructions to NREB Sectt. for treatment of Uri generation during contingent condition 2 nd May,2003 NHPC Letter to NREB Sectt. 8 th May,2003 (Regarding above UI A/C) NREB Sectt. Reply to NHPC 14 th May, 2003 NRLDC Letter to NREB Sectt. 15 th May, 2003 (to amend UI accounts) UI Accounts issued by NREB Sectt.7 th May, 2003 (for period 21 st -27 th April, 2003)

(Petitioner’s Rejoinder Para 11(v), Page-19) Rightly Applicable Clause - IEGC Clause On completion of the operating day, by 2400 hours, the schedule finally implemented during the day (taking into account all before-the-fact changes in dispatch schedule of generating stations and drawal schedule of the states) shall be issued by RLDC. REGARDING PETITIONER’S (MISPLACED) STATEMENT ABOUT RLDC’S RESPONSIBILITY

Attempts To Resolve the Issue Matter was discussed in NREB Board Meeting on 14 th June, 2003 It was agreed to resolve the issue by mutual discussions between NREB Sectt., NRLDC, PDD J&K and NHPC NHPC however did not attend the meeting held in NREB on 16 th June, 2003.

REAL ISSUES Transmission constraints of specific and special kind. Solution as agreed between NRLDC, PDD J & K and Uri HEP was formalized with a copy to NREB Sectt. - to avoid spillage - to maximize generation even under contingency - to maintain secure power supply in Kashmir valley. The above mechanism worked satisfactorily and in a failsafe manner. - no element of protest from any corner.

REAL ISSUES (contd.) Treatment of weekly energy accounting was done by NREB Sectt. in contrast to NRLDC memo. - No reference or discussion made by NREB Sectt. with NRLDC. Petitioner now appears to be longing for undeserved UI earning and has filed a misdirected petition. - any concession or let up would lead to possible spillage at the station and also earning of undeserved UI: leading to national loss and bad practices in the sector. The special mechanism was repeated by NRLDC in the weekly transmittal of SEM energy data to NREB Sectt. - aim was to avoid imposition of an undue UI.

Para 3, Page 7: IT IS RESPECTFULLY SUBMITTED THAT THE WILLFUL, DELIBERATE AND CONTUMACIOUS DEFIANCE AND DISREGARD AND VIOLATION OF THE ORDERS PASSED BY THIS HON ’ BLE COMMISSION MUST NOT BE ALLOWED TO GO UNHEEDED. …………..THE PRESENT PETITION ALSO RAISES A MUCH LARGER ISSUE NAMELY, THE BLATANT AND REPEATED DISREGARD OF STATUTORY AND PUBLIC OBLIGTIONS BY A MONOPOLISTIC PUBLIC UTILITY.

Wrong Interpretation of clauses by NHPC regarding Post-Facto revision of schedule Extracts from Rejoinder from NHPC, Page-19, Para 11(V): NRLDC HAS WILLFULLY NOT REPLACED THE SCHEDULE OF URI POWER STATION DURING THE PERIOD OF TRANSMISSION CONSTRAINT BY THE ACTUAL AGENERATION AS RECORDED BY THE SEMs, THOUGH THE SAME HAS BEEN MENTIONED IN THE STATUS REPORT BY NRLDC. THE ABOVE ACTION CONFIRMS THAT THE RESPONDENT HAS WILLFULLY NOT IMPLEMENTED THE VARIOUS PROVISIONS OF THE ORDERS OF THE HON ’ BLE COMMISSION AND PROVISIONS OF IEGC, WHICH NRLDC SHOULD HAVE DONE EX-POST FACTO OR WHEN THE SAME CAME INTO ITS KNOWLEDGE AS PER THE PROVISIONS MENTIONED IN PARA – 10 (B)(iv) AND PARA-10(C)(ii) OF THE PETITION. NON-REVISION OF THE SCHEDULE BY THE RESPONDENT HAS RESULTED INTO WRONG IMPOSITION OF UI AMOUNT ON THE PETITIONER.

Wrong Interpretation of clauses by NHPC regarding Post-Facto revision of schedule(contd..) Para 10B(iv) of petition ( para 3.13(xvii) of CERC Notification): FOR ANY REVISION OF SCHEDULED GENERATION, INCLUDING POST FACTO DEEMED REVISION, THERE SHALL BE A CORRESPONDING REVISION OF SCHEDULED DRAWALS OF THE BENEFICIARIES. Para 10C(ii) of petition ( IEGC clause 7.5 (15) on scheduling): THE PROCEDURE FOR SCHEDULING AND THE FINAL SCHEDULES ISSUED BY RLDC SHALL BE OPEN TO ALL CONSTITUENTS FOR ANY CHECKING / VERIFICATION, FOR A PERIOD OF 20 DAYS. IN CASE ANY MISTAKE / OMISSION IS DELECTED, THE RLDC SHALL FORTHWITH MAKE A COMPLETE CHECK AND RECTIFY THE SAME.
