Maritime Transportation Security Act / SAFE Port Act Major legislations that changed the security culture of the maritime community Impacted -361 Ports -3,200 facilities Transportation Worker Identification Credential Security and Accountability For Every Port Act

Transportation Worker Identification Credential Common credential identifying individuals who require unescorted access to secure areas Joint TSA / CG effort Three elements of a TWIC compliance check -Verification- Authentication- Validation Visual identification check currently required

TWIC Concepts Important terms -Secure Areas- Restricted Areas -Unescorted Access- Escorting

TWIC Reader Rule Advanced Notice of Proposed Rule Making -Risk-based approach to TWIC reader requirements regulation NPRM based upon results from pilot program and ANPRM comments Future rule may require different levels of TWIC verification based on risk -All will have to supply valid TWIC for unescorted access -Visual and/or biometric check

Fraudulent TWICs Attempts have been made -First known case occurred at Port Fourchon, LA -Identification by facility security staff -Eight cases known to date Fraudulent use will be prosecuted Detection methods -TWIC readers -Human element

Undeclared HAZMAT National Container Inspection Program Federal HAZMAT Transportation Law -International Safe Container Act of Declared HAZMAT, General Cargo & Structural Inspections 26,958 containers inspected Undeclared HAZMAT cases involving 68 containers

Ports conducting inspections Puerto Rico St. Thomas Guam Saipan Port conducted inspections in 2009

Undeclared HAZMAT Cases Undeclared Class 9 Miscellaneous HAZMAT -Four containers shipped as “Freight of All Kind” -Contained polymeric beads Undeclared Class 8 Corrosive Substance -Shipped as scrap metal -Contained batteries -No caps, liquid leaks, hazardous atmosphere

Improvement Efforts Improve targeting efficiency -Liaise with other agencies -Enhance sharing of information Expand guidance and effort on Multi-Agency Strike Force Operations
