Junk Vehicle SMC Neighborhood Services & Code Enforcement Department

What is a Junk Vehicle? Section F. “Junk Vehicle” meets at least 3 of the following conditions: 1. Is 3 years old, or older 2. Is extensively damaged a. Broken window or windshield b. Missing wheels, tires, motor, or transmission 3. Is apparently inoperable 4. Approximate fair market value is equal to the value of the scrap in it

Exceptions: Completely enclosed Section A. Completely enclosed within a building in a lawful manner where it is not visible from the street or other public or private property

Exceptions: Fenced on legitimate business property Section B. Stored or parked in a lawful manner on private property in connection with the business of a licensed dismantler or licensed vehicle dealer and is fenced according to the license provisions

Modify Section Section Removal and Disposal – Costs – Liens A. After notice has been given of the City’s intent to dispose of the vehicle through the notice of abatement or after the appeal hearing has been held, resulting in authority to remove, the vehicle or part thereof shall be removed at the request of a law enforcement officer or limited commission officer and disposed of to a licensed motor vehicle wrecker or hulk hauler with notice to the Washington State patrol and the state department of licensing that the vehicle has been wrecked. B. Failure to remove as a result of a hearing examiner order may result in a class I civil infraction. Costs of removal may be assessed against the registered owner of the vehicle if the identity of the owner can be determined, unless the owner in the transfer of ownership of the vehicle has complied with RCW , or the costs may be assessed against the owner of the property on which the vehicle is stored, subject to SMC

Adding Section Section Failure to Remove Junk Vehicle A. Failure to remove the junk vehicle as outlined in the notice of abatement may result in a class 1 civil infraction, and/or the removal and disposal of the vehicle at the expense of the owner of the land upon which the vehicle is located. Additional fees may be assessed against the registered owner of the vehicle or the owner of the land upon which the vehicle is located, by the City or its designee, for all costs required to abate the nuisance per SMC (D)(7). B. Failure to remove the junk vehicle as a result of a appeal to the hearing examiner may result in a class 1 civil infraction. Additional fees may be assessed against the registered owner of the vehicle or the owner of the land upon which the vehicle is located, by the City or its designee, for all costs required to abate the nuisance per SMC (D)(7).

No change to original intent. Neighborhood Services & Code Enforcement Department Clarifies that a civil infraction may be issued after failure to comply. Provides consistency for the storage and safety requirements of junk vehicles.
