(key provisions from the current agreement) The.aero Sponsorship agreement expires on Dec 17, 2006 –SITA can apply for additional 5 years by Dec 16, 2005 SITA to provide a “Renewal Proposal” containing: –description of its effectiveness in meeting the needs of the Sponsored TLD Community, –proposed additions to or deletions from the Charter and the delegation of policy-development responsibility from ICANN to sponsor, –certification that the Sponsor has complied with all material terms of this Agreement or, where that is not the case, a description of any failure to comply. ICANN to –post the Renewal Proposal for public comment –offer to enter into a new agreement unless the ICANN Board determines, by a two-thirds vote, that continuation of sponsorship is not in the interest of the Sponsored TLD Community and the global Internet community The terms of extension of this Agreement shall be substantially consistent with the terms of agreements between ICANN and sponsors of other Sponsored TLDs.

New sTLD agreements are for the term of 10 years The notion of sponsorship has changed significantly –not-for-profit status no longer required as a condition for sTLD –standards to assess the “representativeness” of the community are less honerous –some sponsors of new TLDs do not contract directly with ICANN Communities of new sponsored TLDs have LESS say in the matters concerning their TLD –It is no longer about delegation of ICANN’s policy development powers to communities –New contracts merely define additional policy development powers for “sponsors” The fee required in new agreements is substantially higher The GNSO Council (policy making body for gTLDs) is a vocal proponent of a “one- size-fits-all” approach where all consensus policies apply to all gTLDs –current policy efforts are heading for micro-regulation of business practices of large TLDs

DAC 8 Renewal proposal to ICANN | Slide 4www.information.aero SITA’s approach for the renewal We believe that we remain the most qualified party to sponsor.aero. –We are not perfect but we are willing to serve the community and have the necessary skill and understanding of technical aspects of the service The domain only makes sense if it be used in the best interest of the aviation community –The aviation community cannot be at a whim of commercial interests of third parties –The voice of Dot Aero Council must be respected, it is on ICANN to demonstrate Industry support key to retain or improve the conditions

DAC 8 Renewal proposal to ICANN | Slide 5www.information.aero Key negotiation points Respect and support ICANN and wish to cooperate full in matters in its efforts to maintain and improve global security, stability and interoperability of the Internet. Require ICANN to respect that matters concerning the.aero TLDs must be primarily decided within the aviation community –Already delegated policy development rights are necessary to manage the domain in the best interest of the community –Registrar model is inappropriate for the needs of a sponsored TLDs, require the ability to register names directly or via industry entities in addition to ICANN-accredited registrars –New agreement term should be 10 years, consistent with other agreements recently signed by ICANN –Contribution in funding of ICANN activities must be commensurate to the benefits the community can derive from this agreement

DAC 8 Renewal proposal to ICANN | Slide 6www.information.aero Proposed strategy for the renewal Despite some negative developments, we are in a better position than in 2001 –ICANN would have to look for a new sponsor and accept that it failed –2/3 board vote against SITA as a sponsor unlikely Propose to submit a confident and demanding application for renewal –Clear indication of community needs and wants –Argument based on ICANN’s original promise for sTLDs and need of the community for self-governance of the domain Broad industry support will be critical to achieve best conditions for the renewal

DAC 8 Renewal proposal to ICANN | Slide 7www.information.aero Timetable Renewal proposal –Nov 15 - SITA to draft application text and distribute to DAC –Nov 30 - DAC members to provide comments to SITA –Dec 13 - SITA to finalise the text based on comments from DAC members and last minute information obtaining during ICANN meeting in Vancouver –Dec 16 - SITA to formally submit its proposal to ICANN Communication plans –October – SITA to confirm its intention to reapply in.aero newsletter –Nov 15 - SITA to inform all SITA members and key industry associations via mailing campaign –Dec 16, SITA to issue a press release –We kindly ask DAC members to inform its membership of SITA’s intention and their support of this action via their newsletters and other appropriate means
