Directorate-General of Internal Affairs 2 Bratislava, 24th September 2008 National legal framework on THB and Data Collection  Portugal has a legal definition on THB, THB victims’ ID and status and legally framework support scheme for assistance (for adults and children - which have special needs taken into account) As to data collection, the EC Directive on Data Protection was transposed into the national law (1998) and there are also laws of confidentiality and freedom of information in place  STATE-OF-THE-ART

Directorate-General of Internal Affairs 3 Bratislava, 24th September 2008 National legal framework on THB and Data Collection (cont)  REFLECTION on the state-of-the-art Although a series of important legal changes happened since 2007 (e.g. the increase on THB convictions) its success will depend on a gradual alteration of: THB victims’ representation Successful implementation of an infra- structural ecosystem of support and protection Data sharing   

Directorate-General of Internal Affairs 4 Bratislava, 24th September 2008 Data Collection System STATE-OF-THE-ART  Structured disaggregated data on victims and traffickers (socio-demographic profile, location, and mobility, type of THB, type of coercion and so on), collected and stored at a national level is done by key actors (Ministry of Justice, Ministry of Internal Affairs and by one NGO)  There is an innovative programme in terms of training, methodology, tools used, products, type of access to the data and forms of dissemination, nationally framed by: new laws, the 1st National Action Plan and materialized through the creation of a Multidisciplinary Team and a National Repository/monitoring system (SFO)

Directorate-General of Internal Affairs 5 Bratislava, 24th September 2008 REFLECTION on the state-of-the-art Data Collection System (cont)  All mainstream actors can be presented in a pyramidal association… But potentially characterized by clusters of correlation liaisons’  Different missions… Same goals But This means a NETWORK – establishing ‘social contracts’ for intervention through clusters of interdependent analysis

Directorate-General of Internal Affairs 6 Bratislava, 24th September 2008 Expectations related to current Project and Plans Continue to gather data as until now, merging the judicial process dimension and other bodies (governmental and NGOs). Methodological, the process should be done by a co-operative central body, articulating existing or to be exist individual databases. Cultural and organizational obstacles must be considered and society at large must be more committed. Training is fundamental.  Place oriented Knowledge Paradigm - Data gathering on victims, perpetrators and THB should be framed by an ecological approach  As one of the steps to support anti-trafficking efforts
