Legal systems  Continental law system  Anglo-American law system  Islamic law

Legal systems

Anglo-American law system We distinguish two groups of sources:  Primary (principal) sources Statutes (legislation) Common law Case law  Secondary (subsidiary) sources Customes Books of authority

Statutes (legislation)  also „black letter law“  formal written enactments of a legislative authority of the country

Statutes (legislation)

Common law  rules which have been developed entirely by judicial decisions

Common law

Case law  also judge-made law  resulting from judicial decision and interpretation of legislation

Primary sources common lawlegislation case law

Customes & Books of authority  customes = established pattern of behavior  books of authority = law books, reference works, government publications, parliamentary debates ( W/The_Parliamentary_Debates)

Supremacy of law  in the past: „not even king is above the law“  now: checking acts of government agencies by highest court

Summary  Sources Primary Secondary  Today statutes are more important than rules of common law (solving new cases)  Supremacy of law

Thank you for your attention!
