Ozone NAAQS Update On March 12, 2008, EPA established new primary and secondary NAAQS for ground level ozone at ppm. The process of designating areas at attainment or nonattainment was on schedule to be completed by March 12, Several environmental organizations and industry groups petitioned the DC Court of appeals to review the 2008 NAAQS.

Ozone NAAQS Update On Sept 15 th, EPA announced that we will reconsider the 2008 standards for ground-level ozone to ensure the standards are clearly grounded in science and protect public health and welfare with an adequate margin of safety The ozone standards set in 2008 were not as protective as recommended by EPA’s panel of science advisors – –Recommended ppm for primary standards – –Recommended the W126 index for secondary standards The Agency will propose any needed revisions to the ozone standards by December 2009 and issue a final decision by August We will work with our states to accelerate the implementation of any new standards.

NO 2 NAAQS On June 26, 2009 EPA proposed to strengthen the primary NAAQS for nitrogen dioxide (NO 2 ) from the existing NO 2 standard of an annual average of 53 parts per billion (ppb). EPA is proposing to: – –add a 1-hour NO 2 standard at a level between ppb; and – –retain an annual average NO 2 standard at a level of 53 ppb Under a separate review, EPA is considering the need for changes to the secondary NO 2 standard EPA is also proposing changes to the NO 2 air quality monitoring network including monitors to measure: – –Peak, short-term concentrations to support the proposed 1-hour standard – typically near major roads in urban areas, and – –highest concentrations of NO 2 that occur over wider areas The public comment period ended this month and final rule will be out Jan 2010.
