Promotes Research and Development  Research and development of computer software is, in principle, the same as invention of other engineering and science research.  We support patents in these industries so why shouldn’t we in software.  Research and development of computer software is, in principle, the same as invention of other engineering and science research.  We support patents in these industries so why shouldn’t we in software.

Increasing Public Knowledge  Patents publicly disclose the details of the invention, therefore, advancing the public knowledge.  This Increase then sparks an interest in computer software and increases the research and development.  Patents are only valid if the software is not already public knowledge, therefore, it is ensured that public knowledge is increased.  Patents publicly disclose the details of the invention, therefore, advancing the public knowledge.  This Increase then sparks an interest in computer software and increases the research and development.  Patents are only valid if the software is not already public knowledge, therefore, it is ensured that public knowledge is increased.

Protection of IP  Copyrights are not a sufficient method of protection for software therefore it is necessary to have patents in order to ensure concrete protection of fraud.  If you disagree with patenting software then you are essentially disagreeing with any protection of IP.  Copyrights are not a sufficient method of protection for software therefore it is necessary to have patents in order to ensure concrete protection of fraud.  If you disagree with patenting software then you are essentially disagreeing with any protection of IP.

Patents are limited  In order to receive a patent you must make a non obvious technical contribution.  This, along with other rules, reduces the distribution of trivial patents.  Also, if patents are found to be falsely granted, then they can be taken away. This means that development of new ideas is not going to be blocked by invalid patents. (currently 5% of Europe’s patents are being opposed)  In order to receive a patent you must make a non obvious technical contribution.  This, along with other rules, reduces the distribution of trivial patents.  Also, if patents are found to be falsely granted, then they can be taken away. The Industry  The strict intellectual property system in place in the United States is one of the reasons why our economy has been able to grow so quickly, creating new companies and jobs.  Since our economy depends on individual success, patents are necessary in order to maintain this growth.  Are we communist?  The strict intellectual property system in place in the United States is one of the reasons why our economy has been able to grow so quickly, creating new companies and jobs.  Since our economy depends on individual success, patents are necessary in order to maintain this growth.  Are we communist?

…Industry continued  The large amount of software patents that have been filed just goes to show the great need for them.  Small start up companies are able to grow because their IP is protected by patents. This prevents major corporations, such as IBM, from coming in and stealing their ideas.  The large amount of software patents that have been filed just goes to show the great need for them.  Small start up companies are able to grow because their IP is protected by patents. TRIP’s agreement  Currently under article 27 of TRIP’s (Trade Related Aspects of Intellectual Property Rights) agreement, patents must be available for any field of technology.

Cost and Benefits  Although it may be expensive to receive a patent now, the revenue acquired in the long run in many cases will far succeed that spent on obtaining the patent.  The cost to research patentability is also covered by revenue in the long run. Furthermore, there are jobs created in patent research.  Although it may be expensive to receive a patent now, the revenue acquired in the long run in many cases will far succeed that spent on obtaining the patent.  The cost to research patentability is also covered by revenue in the long run. BILL GATES  "If people had understood how patents would be granted when most of today's ideas were invented and had taken out patents, the industry would be at a complete standstill today...The solution is patenting as much as we can. A future startup with no patents of its own will be forced to pay whatever price the giants choose to impose. That price might be high. Established companies have an interest in excluding future competitors."
