Purpose Our purpose today is to discuss the 2014 Workforce Innovation and Opportunity Act as it relates to transition services for all students with disabilities. Dept of Labor Dept of Education

Section 422 PETS Sec. 113 Provision of Pre-Employment Transition Services (a) In general-from the funds reserved under section 110(d) and any funds made available from States, local, or private funding services, each state shall ensure that the designated state unit, in cooperation with the local educational agencies involved, shall provide, or arrange for the provision of, pre-employment transition services for all students with disabilities in need of such services who are eligible or potentially eligible for services under this title.

Two Relevant Definitions in the Act: Student and Youth

Student vs. Youth Student with a Disability (37)(A)(i) (I)(aa) is not younger than the earliest age for the provision of transition services under section 614 (d) (1) (A) (i) (VIII) of IDEA; or (bb) If the state involved elects to use a lower minimum age or receipt of PETS under this act, is not younger than that minimum age, and (II)(aa) is not older than 21 years of age; or (bb) If the state law for the state provides for a higher maximum age for receipt of services under IDEA, is not older than that maximum age; and (ii) (I) is eligible for, and receiving, special education or related services under part B of IDEA; or (II) Is an individual with a disability, for purposes of section 504. They are not interchangeable!

Student vs. Youth Youth with a Disability (42)(A) In General … (i)is not younger than 14 years of age; and (ii)is not older than 24 years of age. Only Student is mentioned in the PETS section of WIOA

PETS Required Activities Job Exploration Counseling Work Based Learning Experiences Post Secondary Counseling Workplace Readiness Training Self Advocacy Instruction The Five Required Activities which may include in-school or after school opportunities, or experience outside the traditional school setting (including internships), that is provided in an integrated environment to the maximum extent possible; Examples may include but are not limited to: Job Readiness trainings Job placement assistance Internships Work Related Materials Occupational and Vocational Training Job Shadowing Experiences Short term On the Job supports Summer Work Experiences On the Job Trainings Apprenticeship programs Project Search

PETS Required Activities Job Exploration Counseling Work Based Learning Experiences Post Secondary Counseling Workplace Readiness Training Self Advocacy Instruction The Five Required Activities Counseling on opportunities for enrollment in comprehensive transition or postsecondary educational programs at institutions of higher education; Examples may include but are not limited to: Dual enrollment opportunities

PETS Required Activities Job Exploration Counseling Work Based Learning Experiences Post Secondary Counseling Workplace Readiness Training Self Advocacy Instruction The Five Required Activities to develop social skills and independent living; Examples may include but are not limited to: Independent living services include (A) IL core services; and …(xvi) training to develop skills specifically designed for youths who are individuals with disabilities to promote self-awareness and esteem, develop advocacy and self-empowerment skills, and explore career options; IL Core Services are (17) (A) information and referral services; (B) independent living skills training; (C) peer counseling; (D) individual and systems advocacy; (E) services that (i) facilitates the transition … from nursing homes and other institutions to home and community based residences with the requisite supports and services; (ii) provides assistance to individuals …who are at risk of entering institutions so that the individuals may remain in the community; and facilitates the transition of youth who were eligible for IEPs and have completed their secondary education or otherwise left school, to post-secondary life. PETS Required Activities Job Exploration Counseling Work Based Learning Experiences Post Secondary Counseling Workplace Readiness Training Self Advocacy Instruction The Five Required Activities which may include peer mentoring Examples may include but are not limited to: Disability Skills Training Mock Interviews Benefits Planning & Financial Readiness LifeSkills Coaching Mentoring Programs

(c) Authorized Activities Funds available under subsection (a) and remaining after the provision of the required activities in (b) may be used to improve transition of students with disabilities described in subsection (a) from school to postsecondary education or an employment outcome by--

(d) PET Coordination Each local office shall carry out responsibilities consisting of— (1)Attending IEP meetings for students with disabilities, when invited; (2)Working with the local workforce development boards, one- stop centers, and employers to develop work opportunities for students with disabilities, including internships, summer employment and other employment opportunities available throughout the school year, and apprenticeships; (3)Work with schools to coordinate and ensure the provision of PETS under this section; and (4)when invited, attend person-centered planning meetings

Career Work Experience Certification KY CTE Work-Based Learning Options: Include in Cooperative Education Entrepreneurship Internship (Paid-Unpaid) Mentoring School-based Enterprise Service Learning Shadowing Course of Study Descriptions: Alternate Assessment The student’s multi- year Course of Study documents the completion of the CWEC Kentucky State Personnel Development Grant/CCR Work-Based Learning Programs Vehicles for implementing a % of the work-based learning options CBWTP District Develop Program Combination

The Supported Higher Education Project (SHEP) serves Kentucky residents ages 18 to 26 who have an intellectual disability and an interest in attending a college or university in the state. The Higher Education Opportunity Act Amendments (2008) provide the tools needed for students with intellectual disabilities to continue their education.

The CBWTP is a collaboration project between Office of Vocational Rehabilitation (OVR), Kentucky Department of Education (KDE) and Local Education Agency (LEA), working together to allow students with a desire to work, to experience community jobs (individually based on their strengths, preferences, and interests) during their final two years of high school with the assistance of a job coach.
