DETAILED ANALYSIS MOCK TEST 6 ( )

INTRODUCTION Mock Test 6 follows the NLU-D pattern wherein the students are subjected to the same level of difficulty both in terms of question type and level. The mock test comprises of five sections with a total of 150 questions. A student is expected to attempt this test in an actual test like environment wherein he has 90 minutes to complete the test and thus need to schedule his/her time accordingly. LEGAL APTITUDE This section had 35 questions on Legal Aptitude comprising of both Legal Reasoning as well as Legal Knowledge. The section consisted of: Legal Reasoning (20 questions) Legal Knowledge (15 questions) Overall, the section was of Moderate difficulty level. The Legal Reasoning section specifically tested the ability of students to understand and interpret the legal principles and application of the same to factual matrix to reach the best answer. And, in order to answer the questions based on Legal Knowledge, students were expected to have some basic knowledge of various concepts under Constitutional Law, Criminal Law and Law of Contracts and further to be acquainted with general legal principles. An attempt between the range of 30 would be considered a good attempt for this section.

DETAILS  Legal Reasoning: The Legal Reasoning of Mock 6 was having a Moderate difficulty level. This section was dominated by questions from Criminal Law, Torts and Contracts Law, along with a couple of questions from Constitutional Law.  An approach of very careful and timely reading of the principles was required.  Legal Knowledge: The Legal Knowledge part of Mock 6 focused on questions from General Principles of Law. Apart from that there were questions from Constitutional Law, Contracts, Criminal Law, Torts, Family Law.

DETAILS Question 2: This question deals with the topic of Public and Private Nuisance under Torts. In this question, the act of setting up a tea stall by A amounts to Nuisance and would be classified as Public Nuisance because the interference is caused for the public in general. An easement is a right to use another's property. It is a right, which the owner of a particular land enjoys over an adjacent property, which he does not possess. In this case, the right of easement cannot be acquired since it’s a public nuisance and one cannot acquire an easementary right over public property.

DETAILS Question are based on the tort of nuisance and the right of easement acquired by prescription. In question 17, a specific point of law has been provided where determining whether A has acquired prescriptive right to commit nuisance is easy. Although A has been manufacturing utensils for over 20 years, B moved in recently and assuming B has been tolerating the noise for more than 20 years is irrational. In question 18, it has been asked whether A can take a defense that B should have been careful n should have known about the repercussions of renting the place especially since the noise in that area was from over such a long period of time. B indeed should have been more careful before moving in and hence A indeed can take the defence. In question 19, the question asks for an overall encompassing decision whether B's action of permanent injunction would succeed. Deriving from question 18's analysis we can easily make out that B's action would fail.

DETAILS Question 34 is a question of Legal knowledge. The correct answer option is (d). Here is a brief note on Quasi Judicial body for a better understanding. A quasi-judicial body is an entity such as an arbitrator or tribunal board, generally of a public administrative agency, which has powers and procedures resembling those of a court of law or judge, and which is obligated to objectively determine facts and draw conclusions from them so as to provide the basis of an official action. Such actions are able to remedy a situation or impose legal penalties, and may affect the legal rights, duties or privileges of specific parties.

GENERAL KNOWLEDGE This section of MOCK TEST – 6 has 35 questions in all. This test primarily focused on static GK. Out of total 35 questions, 24 questions were from static GK and 11 questions from current affairs. Static GK was oriented towards geography, general science and technology, economy and history. Overall difficulty level was moderate. Current affairs were mainly based on personality; apart from it questions were also from misc. field. The difficulty level of current affairs was easy to moderate. Further, the final break-up summary can be analyzed with the help of following table:

The words whose antonyms were asked were slightly difficult and in all, a student should have attempted at least 5 questions. 135 to 147 Fill in the Blanks Easy - Moderate The questions were moderate in difficulty and required strong fundamentals in grammar. 148 to 150 Para Jumbles (Five Sentence Type) Moderate The sentences were long and required patience and concentration to get them right. They were time consuming too. Atleast 2 out of 3 questions should have been attempted.
