> > The Consolidated Waiver and Person/Family Directed Support (P/FDS) Waiver are set to expire on June 30, ODP is launching a state-wide series of Listening Sessions to solicit feedback and understand what changes our stakeholders, individuals and families would like to see implemented. > > Institutional requirements are “waived” for home and community- based services. Medicaid home and community-based services are authorized in Section 1915c of the Social Security Act. Programs are funded by federal and state dollars. The Center for Medicare and Medicaid Services (CMS) is the federal agency that approves and provides oversight of waivers. States must apply to CMS for approval and renewal of waivers. –Waiver renewal period: 5 years –Current authorization period: 7/1/12 through 6/30/17 What is a Waiver? 4

> > CMS HCBS Final Rule 5 CMS published the final rule amending regulations contained in 42 CFR on January 16, 2014 The rule supports enhanced quality in Home and Community Based Services (HCBS) programs and adds protections for individuals receiving services. In addition, this rule reflects CMS’ intent to ensure that individuals receiving services and supports through Medicaid’s HCBS programs have full access to the benefits of community living and are able to receive services in the most integrated setting. Waiver renewal will include changes to implement the final rule.
