Las Vegas Confusion Copyright Brief LIBM 6320 Saundra Lamberson

Case Title Tiffany Design, Inc. v. Reno-Tahoe Specialty, Inc., 55F. Supp. 2d 1113 Copyright Infringement

Plantiff Tiffany Design took aerial photographs of the Las Vegas Strip and used Photoshop to alter their appearance for an image for a poster. A federal copyright registration for the 1998 Image was obtained (Google Scholar, 2011).

Defendant Reno-Tahoe Specialty scanned Tiffany Design’s photo and inserted at least 6 architectural works from the 1998 Image into one of their own products with an intention to sale (University of Maine, 2011).

Applicable Law Copyright Infringement: Tiffany Design demonstrated ownership of a valid copyright and proved that Reno-Tahoe Specialty copied protected elements of a copyrighted work (Google Scholar, 2011).

Reflection Creative products such as photos, videos and music are unique to their creator and extreme caution should be used when copying them. Seek permission for use
