2009 Legislative Session Housing & Services Impacts

Provider Rate Changes Effective 7/1/ % provider cut effective 7/1/09 for fee-for- service and 10/1/09 for managed care (previous COLA plans no longer applicable) 95% cap in each Elderly Waiver 24-hour Customized Living case mix, based on 3/09 rate Component rates for 24-hour CL to be established 7/1/09 Lower Case Mix A rate limits in AC and EW for clients with limited ADL needs

Eligibility Changes Effective 1/1/11 Thresholds for Nursing Home Level of Care determination increased $400 Essential Community Support grant for those no longer eligible for waivered programs

Eligibility Changes Effective 1/1/11 Authorization for EW 24-hour CL based on one or more of the following: –need for intermittent assistance with toileting, positioning, or transferring; –need for assistance with cognitive or behavioral issues; –medical condition that requires clinical monitoring; –or dependency in at least two ADLS (bathing, dressing, grooming, walking, or eating); and needs medication management and at least 50 hours of service per month.
