UCB/LBNL Partnership Agreement for ES&H Policy and Procedure Background –Around 600 UC Berkeley Researchers are associated with LBNL Materials Sciences ~200 Physical Biosciences ~200 Chemical Sciences ~100 Other Divisions balance –The Department of Energy expects that its safety systems will be applied anywhere, to anyone performing DOE-funded work –Likewise, UCB has safety systems covering work at the UCB campus –Agreements between LBNL and UC Berkeley covering EH&S issues have existed for many years, prior to 2004 the agreement was signed in June, 1993

UCB/LBNL Partnership Agreement for ES&H Policy and Procedure Official Signature Date is 15 March, 2004.

How does the Partnership Agreement affect Campus Researchers? LBNL standards and requirements apply in LBNL space, and UCB standards and requirements apply in UCB (Appendix I) space Donner, Calvin and Potter Street are considered LBNL space Other UCB space in which LBNL work is performed is considered UCB space (this space is called “Appendix I” space)

Implementation: Partnership Agreement Responsibility for EHS in any space rests with the line manager (Principal Investigator) of that space. DOE’s Integrated Safety Management System applies to all LBNL work, wherever and by whomever it is performed. –This means that researchers have a certain responsibility to their LBNL Division for DOE work performed in UCB Space

Implementation: Partnership Agreement The programs at LBNL and UCB are both consistent with ISM. Conformance with UCB requirements fulfills the obligation to DOE. Conformance must be documented to LBNL.

Implementation: Partnership Agreement How will this ultimately be accomplished? –Job Hazards Questionnaire: anyone with an LBNL appointment must take the on-line JHQ. The JHQ has a provision asking where the individual works (LBNL, UCB, both). The JHQ reflects UCB training requirements for workers at UCB, LBNL requirements for workers at LBNL. –Training: LBNL training applies at LBNL, UCB training applies at UCB. LBNL’s system tracks both. LBNL and UCB will cooperate on classes with interest to both. –Self-Assessments: UCB’s existing annual self-assessment requirement fulfills this; LBNL Divisions should get a copy of the form. –Validation: UCB will validate inspections of Appendix I spaces.

Additional Points Other significant points –Students are specifically called out as individuals for whom the Principal Investigator is responsible. –Principal Investigators, having primary responsibility for EHS, may exceed the minimum requirements of the Partnership Agreement at any time. –Inspections will be conducted by the EH&S office overseeing the space. Other EH&S office may accompany and comment. –Accidents will be co-investigated when necessary. –EH&S responsibilities during Construction, Renovation and Maintenance have been clarified.

Summary –Existing practice of UCB setting standards for UCB spaces, and LBNL setting standards for LBNL spaces, is maintained. –ISM responsibility for LBNL research in App. I space is confirmed; consists of conforming with UCB requirements. –LBNL and UCB cooperating on procedures to make both sides benefit.
