WP4 – Legal and Governance Framework for TCS and ICS Implementation Elisabeth Kohler & Helle Pedersen (CNRS), Annakaisa Korja & Pirjo Kontkanen (UH), Florian Haslinger (ETH), Jörn Lauterjung (GFZ)

Tasks and Team 4.1 Harmonization of the TCS legal and governance framework (Elisabeth Kohler, CNRS) 4.2 Establishment of ICS legal and governance framework (Annakaisa Korja & Pirjo Kontkanen, UH) 4.3 Implementation and monitoring of the EPOS data policy (Florian Haslinger, ETH) 4.4 Harmonizing access policies to facilities and instrumentation (Jörn Lauterjung, GFZ) 4.5 Monitoring the pre-operational phase for the TCS implementation (Helle Pedersen, CNRS)

Objectives Establish a robust, coherent, transparent and sustainable legal and governance structure across all of the EPOS services (TCS/ICS) and aligned to the EPOS Architecture; Establish clear legal links/connections between EPOS-ERIC and the legal entity/consortium of legal entities of each TCS/ICS; Identify the long-term strategy for the legal and governance of each TCS/ICS and take first steps to achieve this outcome; Ensure the implementation of the EPOS data policy and harmonization of access rules to facilities and instrumentation; Interact with WP3 and WP5 to develop an integrated legal, governance and financial harmonization plan for TCS implementation

Why are harmonised governance, data and access policy added value to TCS? Governance : to participate in EPOS and its strategy through a clear definition of responsabilities, duties and rights Data policy : easier, safer, better and larger access to data through common policy Transnational access to facilities : make facilities available for the whole community

Interacting with TCSs to advice and help in a proactive way each TCS to set up a governance scheme and data and access policy. to provide the tools to assess and evaluate the progress made within each TCS and to report the results to EPOS. Short : It is not the responsibility of WP4 to set up the TCS governance for the TCS but to test the legal and governance maturity of the TCS for implementation

Feedback from questionnaire Thank you for the information: very useful to plan WP4 work. We now have a more precise view on the plans of each TCS. General information: The TCS have a common understanding of why the issues of WP4 are important to them, and which are the special points to address; homogeneity is expected. The TCS are expecting practical support from WP4 WP4 will provide Support Guidelines (what is expected) Examples/models

4.1 Harmonization of the TCS legal and governance framework

Provide a legal and governance structure for each TCS Identification of the partners in each TCS and interaction mechanisms with the community Which type of legal structure (consortium, legal entity,…)? Definition of the governance bodies Decision-making process and type of decisions; voting rights Who advices the TCS and on which subjects? Definition of responsibilities, rights and duties Reporting mechanisms Who is representing the TCS to the ‘outside’ world? Conflict resolution mechanism

Models for TCS legal structure Consortium MoU Organisation 1 Organisation 2 Organisation 3 Oranisation 4 Single legal entity Legal entity Organisation 3Organisation 2Organisation1

Define interfaces with EPOS-ERIC -Which type of agreement between TCS and ERIC? (note: this depends on the type of agreement at TCS level) -Definition of tasks/services to be provided by TCS -Reporting and control mechanisms

EPOS-ERIC Legal and Governance model

EPOS Governance structure

EPOS-ERIC coordinates the TCSs through : Service Contracts Legal agreements Governance and Interaction with EPOS ERIC EPOS- ERIC

Timeline -M1-M6 : WP4 works with each TCS on a governance model and provide a final set of guidelines -M6-M12 : TCS internal discussion on chosen model -M12-M18 : WP4 works on harmonization of the governance of the different TCS and the compliance with EPOS-ERIC legal and governance scheme -M18-M24 : implementation of the TCS governance -M24-M36 : service agreements between TCS and EPOS-ERIC

4.2 Establishment of ICS legal and governance framework

This work can only start in spring Similar to Task 4.1 but pending issue of site selection for ICS central hub and identification of ICS distributed services -ICS central hub : location and structure of ICS will be known in March ICS distributed services : selection of technology and resources providers linked through service agreements to EPOS-ERIC will be launched in

4.3 Implementation and monitoring of the EPOS data policy

Pending issue (EPOS-ERIC/WP3/WP4) -Data policy document needs to be updated (specially regarding Intellectual Property Rights and references to EC framework) and then validated by BGR : this work has started. First draft Jan 2016? -Extension to guidelines for Data Life-Cycle Management?

Timeline for the implementation of data policy -Implementation : identification and potential resolution of discrepancies and conflicts and guidelines for implementation -M4-M12 -Definition of appropriate tools for monitoring the implementation -M12-M18 -Assessment of the implementation of data policy: -M18-M36

Present state and plans -Physical access only concerns WP8, W11, W16 -Create small dedicated group to harmonise Access rules (WP3/WP4) -Has to match the European Charter for Access to Research Infrastructures and rules for transnational access -Timeline to be prepared, after first discussion with the concerned TCS
