M mc DIRECTIVE 2003/59/EC DIRECTIVE 2003/59/EC ON THE INITIAL QUALIFICATION AND PERIODIC TRAINING OF DRIVERS OF CERTAIN ROAD VEHICLES FOR THE CARRIAGE OF GOODS OR PASSENGERS  Scope nationals of a Member State nationals of third countries who are employed or used by an undertaking established in a Member State category of driving licence vehicles C1, C1+E, C or C+E D1, D1+E, D or D+E

M mc DIRECTIVE 2003/59/EC  MAIN EXEMPTIONS Vehicles used by, or under the control of, the armed forces, civil defence, the fire service and forces responsibles for maintaning public order Vehicles used for non-commercial carriage of passengers or goods, for personal use Vehicles carrying material or equipment to be used by the driver in the course of his or her work, provided that driving the vehicle is not the driver´s principal activity

M mc DIRECTIVE 2003/59/EC  QUALIFICATION AND TRAINING 1. System of initial qualification, two options: (i) option combining both course attendance and a test (ii) option involving only test theoretical practical UPON SUCCESSFUL COMPLETION OF THE TEST, THE QUALIFICATIONS SHALL BE CERTIFIED BY A CPC ( Certificate of Professional Competence ), that permit to drive: Goods. From the age of 18, vehicle categories C and C+E Passengers. From the age of 21, vehicle categories D and D+E

System of accelerated initial qualification Goods Drivers from the age of 18, vehicles C1, C1+E Goods Drivers from the age of 21, vehicles C, C+E Passangers Drivers from the age of 21, vehicles D, D+E to carry passengers on regular services where the route does not exceed 50km, and vehicles D1 and D1+E Passengers Drivers from the age of 23, vehicles D and D+E The accelerated initial qualification shall involve compulsory course attendance and shall conclude with a test, the successful of the test shall be certified by a CPC

M mc DIRECTIVE 2003/59/EC 3. SYSTEM OF PERIODIC TRAINING Periodic training involves compulsory course attendance Certified by a CPC

M mc DIRECTIVE 2003/59/EC Acquired rights  Drivers shall exempted from the requirement to obtain an initial qualification: Drivers who hold a category D1, D1+E, D or D + E, issued no later than two years after the final date for the transposition Drivers who hold a category C1, C1+E, C or C+E, issued no later than three years after the final date for the transposition

M mc DIRECTIVE 2003/59/EC  CPC CERTIFYING THE QUALIFICATION CPC Initial qualification and accelerated initial qualification Drivers attend courses in a training centre approved by the competent authorities. This training shall conclude with successful completion of the test provided in the Annex I. CPC awarded on the basis of tests Drivers must pass the theoretical and practical tests referred to Annex I  The test shall be organised by the Member States´competent authorities or an entity designated by them

M mc  PERIODIC TRAINING Consist in a training to enable holders of a CPC to update the knowledge which is essential for their work. Specific emphasis on road safety and the rationalisation of fuel consumption The training shall be organised by an approved training centre. When a driver has completed the periodic training the Member States´competent authorities or the approved training centre shall issued a CPC The drivers who shall undergo a first course of periodic training are: Holders of a CPC within five years of the issue of that CPC Drivers with acquired rights, within five years referred to transposition and implementation DIRECTIVE 2003/59/EC

M mc  PLACE OF TRAINING Drivers nationals of a Member State shall obtain the initial qualification in the Member State in which they have their normal residence Drivers nationals of third countries who are employee or used by an undertaking established in a Member State shall obtain the initial qualification in the Member State in which the undertaking is established or in the Member State which issued a work permit to them For the periodic training in the Member State in which drivers have their normal residence or the Member State in which they work DIRECTIVE 2003/59/EC

M mc  COMMUNITY CODE Member States´competente authorities shall mark the Comunity Code alongside the corresponding categories of licence: Either on the driving licence Or on the driver qualification card drawn up in Annex II of the Directive DIRECTIVE 2003/59/EC

M mc  TRANSPOSITION AND IMPLEMENTATION Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive before 10 September 2006 From 10 September 2008 as regards the initial qualification for passengers drivers From 10 September 2009 as regards the initial qualification for freight drivers DIRECTIVE 2003/59/EC

M mc  ANNEX I Compulsory initial qualifications Option combining both course attendance and a test  The duration of initial qualification must be 280 hours  Each trainee driver must drive for at least 20 hours individually in a vehicle concerned  Each driver may drive for a maximum of 8 hours of the 20 hours on special terrain or on a top-of-the-range simulator  Drivers who modified their activities, the length of the initial qualification must be 70 hours, incluiding 5 hours of individual driving DIRECTIVE 2003/59/EC

M mc Option involving a test The theorical test shall consist of at least two parts: 1) Questions including multiple-choice questions, questions requiring a direct answer, or a combination of both 2) Case studies the minimun duration of the theoretical test must be 4 hours The practical test shall consist of two parts: 1) A driving test, minimum test must be 90 minutes 2) A practical test, minimum duration must be 30 minutes DIRECTIVE 2003/59/EC

M mc DIRECTIVE 2003/59/EC  Accelerated initial qualifications The duration must be 140 hours Each trainee must drive at least 10 hours Each driver may drive for a maximum of 4 hours of the 10 hours on special terrain or on a top-of-the-range simulator For drivers who modify their activities the length must be 35 hours, including 2,5 hours of individual driving At the end of that training, the driver must past a written or oral test.

M mc DIRECTIVE 2003/59/EC  COMPULSORY PERIODIC TRAINING Must be organised by an approved training centre. Their duration must be of 35 hours every 5 years, given in periods of at least 7 hours. Such periodic training may be provided, in part, on top-of-the-range simulators
