Legal challenges in reviewing application for final disposal of spent fuel Tomas Löfgren

Present situation in Sweden Application for a final disposal facility submitted 2011 A complex review and assessment process is now underway SSM's role: –Review and assess application regarding radiation protection and nuclear safety aspects –Ask for stakeholders opinion –Leave final statement with own opinion to Government Government makes final decision

Reviewing implies… assessment of something… –for which SSM lacks earlier experience regarding… a technical solution… –that does not yet exist… based on… –requirements (principles, goals and ) involving… a number of laws in a complex interaction between e.g. –Act on nuclear activities –Radiation protection act –Environmental code

How to apply legal requirements in practice… Avoid burden on future generations Conservation of natural resources Alternative sites and disposal methods The precautionary principle The best possible technology Deficiencies in an application New nuclear power reactors?

Conclusion The submitted application is a big development towards a solution of the disposal of spent fuel and radioactive waste Still some hard considerations has to be done SSM has to strictly focus on reviewing and assessing aspects of radiation protection and nuclear safety Ultimately the Government decides
