Discipline and Students with Disabilities Annual Training

10 days of OSS  Up to 10 days of OSS - discipline all students exactly the same  10 days can either be a one time shot or cumulative over time that creates a pattern

Over 10 days of OSS  The IEP team must meet  Hold a manifestation determination meeting  Decide if the behavior is a manifestation of this child’s disability or if the IEP was not properly implemented by the school

If the answer is NO  Discipline the student according to district policy

If the answer is YES  The district cannot deny the student FAPE: Free and Appropriate Public Education  The district must decide how to provide special education services noted in the student’s IEP  Sometimes this results in a change of placement for the student

If the answer is YES  A Functional Behavior Assessment (FBA) is completed and a Behavior Intervention Plan (BIP) developed
