10 days of OSS Up to 10 days of OSS - discipline all students exactly the same 10 days can either be a one time shot or cumulative over time that creates a pattern
Over 10 days of OSS The IEP team must meet Hold a manifestation determination meeting Decide if the behavior is a manifestation of this child’s disability or if the IEP was not properly implemented by the school
If the answer is NO Discipline the student according to district policy
If the answer is YES The district cannot deny the student FAPE: Free and Appropriate Public Education The district must decide how to provide special education services noted in the student’s IEP Sometimes this results in a change of placement for the student
If the answer is YES A Functional Behavior Assessment (FBA) is completed and a Behavior Intervention Plan (BIP) developed
