هيئة تنظيم قطاع الاتصالات دور هيئة تنظيم قطاع الاتصالات في تعزيز النزاهة في بيئة الأعمال في الأردن 1

دور هيئة تنظيم قطاع الاتصالات في تعزيز النزاهة في بيئة الأعمال في الأردن يتطلب عمل الهيئة في تنظيم نشاطات أسواق الاتصالات وتكنولوجيا المعلومات والبريد قدراً عالياً من النزاهة في التعامل مع مقدمي الخدمات والمستفيدين من تلك الخدمات. تعتمد الهيئة في ممارساتها لتعزيز النزاهة مرجعيات محددة في قانون الاتصالات وفي التعليمات التي تصدرها الهيئة لهذه الغاية. 2

النزاهة في التعامل مع مقدمي الخدمات (1) تضمين شروط وأحكام موحدة في اتفاقيات الترخيص لجميع المرخص لهم (الإطار التنظيمي المتكامل للتراخيص). عدم إجراء أي تعديل على شروط وأحكام الترخيص لأي مرخص له دون الآخرين الذين هم في نفس الوضع (المادة 39 من قانون الاتصالات: أ. مع مراعاة أحكام الفقرة (ب) من هذه المادة للمجلس أن يقرر تعديل شرط أو أكثر من شروط الترخيص، وتتبع الإجراءات التالية في التعديل:- 1-يبلغ المجلس المرخص له إشعارا خطيا بالتعديل وأسبابه والمدة المقررة لتنفيذه وللمرخص له تقديم اعتراضه على ذلك التعديل خلال المدة التي يحددها المجلس. 2- على المجلس أن يدعو المعترض للمناقشة وسماع أسباب اعتراضه وله أن يقرر بالنتيجة إما إقرار التعديل أو تأجيل نفاذه أو قبول الاعتراض. ب. لا يجوز تعديل شروط الترخيص لأحد المرخص لهم دون المرخص لهم الآخرين إذا توافرت الأسباب الموجبة لذلك التعديل في شروط ترخيصهم أيضاً). 3

النزاهة في التعامل مع مقدمي الخدمات (2) إصدار تعليمات خاصة بكلٍ من النشاطات الرئيسية التي يمارسها المرخص لهم (تعليمات حماية المنافسة ، تعليمات الربط البيني ، تعليمات فض المنازعات....الخ). اعتماد أسلوب الاستشارات العامة في إصدار التعليمات الناظمة لأعمال القطاعات الخاضعة للتنظيم (تعليمات القواعد الإجرائية لإصدار التعليمات). ضمان ربط شبكات المرخص لهم بعضها ببعض دون تمييز (المادة 29 مكرر من قانون الاتصالات: يتوجب على كل مرخص له العمل على إنجاز اتفاقيات ربط بينه وبين المرخص لهم الآخرين حسب متطلبات رخص كل منهم على أن تتناول تلك الاتفاقيات جميع الشروط المتعلقة بالنواحي الفنية والتشغيلية والإدارية والمالية والتجارية التي تضمن المرونة اللازمة للتنفيذ من قبل أطرافها). 4

النزاهة في التعامل مع مقدمي الخدمات (3) اعتماد أسلوب العطاءات العامة في منح رخص الترددات الراديوية لشبكات الاتصالات العامة (المادة 32 من قانون الاتصالات: لمجلس الوزراء بناء على تنسيب الوزير المستند إلى توصية المجلس، الموافقة على إتباع أسلوب طرح العطاءات العامة لمنح رخص لاستخدام الطيف الترددي الراديوي في الحالات التي تتطلبها المصلحة العامة مع مراعاة أن لا يكون مقدار العوائد المتوقعة من هذا الأسلوب السبب الوحيد أو الرئيسي لتقدير هذه المصلحة). 5

النزاهة في ضمان حقوق المستفيدين (1) حماية مصالح المستفيدين من خدمات الاتصالات وتكنولوجيا المعلومات (المادة 6 من قانون الاتصالات: تتولى الهيئة المهام والمسؤوليات التالية: أ) تنظيم خدمات الاتصالات وتكنولوجيا المعلومات في المملكة وفقا للسياسة العامة المقررة لضمان تقديم خدمات الاتصالات وتكنولوجيا المعلومات للمستفيدين بسوية عالية وأسعار معقولة وبما يحقق الأداء الأمثل لقطاعي الاتصالات وتكنولوجيا المعلومات. ب) وضع أسس تنظيم قطاعي الاتصالات وتكنولوجيا المعلومات بما يتفق مع السياسة العامة المقررة لتقديم تلك الخدمات على النحو الذي تقتضيه متطلبات التنمية الشاملة في المملكة وذلك بمقتضى تعليمات يصدرها المجلس لهذه الغاية. 6

النزاهة في ضمان حقوق المستفيدين (2) ج) تحديد الحد الأدنى لدرجة جودة الخدمة التي يلتزم المرخص لهم بتقديمها لتحقيق حاجات المستفيدين بالتشاور مع المرخص لهم ودون إلزامهم بحلول تقنية محددة. د) حماية مصالح المستفيدين ومراقبة الأشخاص والجهات المرخص لها للتأكد من الالتزام بشروط الرخصة بما في ذلك مواصفات الخدمات المقدمة وجودتها وأسعارها واتخاذ الإجراءات القانونية اللازمة بحق من يخالف هذه الشروط. ه) تحفيز المنافسة في قطاعي الاتصالات وتكنولوجيا المعلومات بالاعتماد على عوامل السوق وتنظيمها بصورة تكفل فاعليتها في تقديم خدمات الاتصالات وتكنولوجيا المعلومات والتأكد من أن تنظيمها يتم بصورة كافية وفاعلة لمنع المنافسات غير المشروعة أو الحد منها أو منع إساءة استخدام أي شخص لوضعه المهيمن في السوق واتخاذ الإجراءات اللازمة لهذه الغاية). 7

The Role of the Commission In Enhancing Integrity in the Business Environment in Jordan The tasks of the Commission in regulating the activities of the Telecommunications, Information Technology and Postal sectors require a high degree of integrity in dealing with the Service Providers and Beneficiaries from those services. The Commission, in its practices for applying and enhancing integrity, relies on specific provisions in the Telecommunications Law as well in the Instructions that the Commission issues for this purpose. 9

Integrity in dealing with Service Providers (1) Common terms and conditions in the License Agreements for all Licensees (The Integrated Licensing Regime). No modification of License terms or conditions for any Licensee without applying the same to other similarly situated Licensees (Article 39 of the Telecommunications law: a. Subject to the provisions of Paragraph (b) of this Article, the Board may decide to amend one or more of the licensing conditions. Such amendment shall be made according to the following procedure: 1. The Board shall notify the Licensee in writing of the amendment, its reasons and the period set for its implementation. The Licensee may submit his objection to that amendment within the period set by the Board. 2. The Board shall invite the objector to discuss and hear the reasons of his objection; it consequently may decide either to approve the amendment, or postpone its enforcement or accept the objection. b. The amendment of the licensing conditions shall not be restricted to a single Licensee with the exclusion of others, if the reasons calling for such amendment are available too in the licensing conditions of the other Licensees.) 10

Integrity in dealing with Service Providers (2) Issuance of specific Instructions for main activities practiced by Licensees ( Competition Safeguards Instructions, Interconnection Instructions, Dispute Resolution Instructions …etc.). Adopting Public Consultation process in issuing Instructions for regulating the sectors that are subject to regulation ( Rulemaking Instructions ). Ensuring interconnection of Licensees networks without discrimination. ( Article 29-bis of the telecommunications Law: Every Licensee shall conclude interconnection agreements with other Licensees as required by the license of each of them; these agreements shall address all the technical, operational, administrative, financial, and commercial terms and conditions that will ensure the flexibility required for implementation by the involved ). 11

Integrity in dealing with Service Providers (3) Adopting public tender processes in granting Radio Frequency Licenses for Public Telecommunications Networks ( Article 32 of the Telecommunications Law: Based on the representation of the Minister that is based on the recommendation of the Board, the Council of Ministers may authorize the use of public tendering to grant licenses to use the Radio Frequency Spectrum in cases where this method will serve the public interest, provided that the revenues expected from this method shall not be the sole or main reason for the determination of this interest ). 12

Integrity in Ensuring the Rights of Beneficiaries (1) Protection of the rights of Beneficiaries from Telecommunications and Information Technology Services. ( Article 6 of the Telecommunications law: The Commission shall undertake the following duties and responsibilities: a. To regulate telecommunications and information technology services in the Kingdom in accordance with the established general policy so as to ensure the provision of high quality Telecommunications and Information Technology services to Beneficiaries at reasonable prices; and, by so doing, to make possible the optimal performance of the telecommunications and information technology sectors. b. To establish the basis for regulation of the telecommunications and information technology sectors, in accordance with the established general policy, in such a way that services meet the needs of the comprehensive development in the Kingdom in accordance with instructions issued by the Board for this purpose. 13

Integrity in Ensuring the Rights of Beneficiaries (2) c. To specify the minimum level of service quality which must be committed by licensees to meet the needs of Beneficiaries. This shall be done in consultation with licensees and shall be without the imposition of any specific technological solutions on them. d. To protect the interests of Beneficiaries and monitor the actions of persons and licensed parties to ensure that the conditions of Licenses are observed, including specified service standards, service quality, and prices; and to take the necessary legal against those who violate these conditions. e. To stimulate competition in the telecommunications and information technology sectors, relying on market forces, and so regulating them as to ensure the effective provision of telecommunications and information technology services and to ensure that its regulation is sufficient and effective to prevent or curtail illegal competitive practices or prevent any person with a dominant position in the market from abusing his position, and to take all necessary actions in this regard.). 14
