2 Changes for the 2005 Opinion Instructions  Replacement of Appointed Actuary  Actuarial Opinion Summary – required.  Contents of AOS

3 Replacement of Appointed Actuary  “If an actuary who was the Appointed Actuary for the immediately preceding filed Actuarial Opinion is replaced by an action of the Board of Directors, the insurer shall within five (5) business days notify the Insurance Department of the state of domicile of this event. The insurer shall also furnish the domiciliary Commissioner with a separate letter within ten (10) business days of the above notification stating whether in the twenty four (24) months preceding such event there were any disagreements with the former Appointed Actuary regarding the content of the opinion on matters of the risk of material adverse deviation, required disclosures, scope, procedure, or data quality…”

4 Replacement of Appointed Actuary (continued.)  “…The disagreements required to be reported in response to this paragraph include both those resolved to the former actuary’s satisfaction and those not resolved to the former actuary’s satisfaction. The insurer shall also in writing request such former actuary to furnish a letter addressed to the insurer stating whether the actuary agrees with the statements contained in the insurer’s letter and, if not, stating the reasons for which he does not agree; and the insurer shall furnish such responsive letter from the former actuary to the domiciliary Commissioner together with its own.”

5 Actuarial Opinion Summary  “For all companies that are required by their domiciliary state to submit a confidential document entitled an Actuarial Opinion Summary (AOS), such document shall be filed with the domiciliary state no later than March 15. This AOS shall be submitted to a non-domiciliary state within fifteen days of request, but no earlier than March 15, provided that the requesting state can demonstrate, through the existence of a model law or some similar means, that they are able to preserve the confidentiality of the document. “

6 Actuarial Opinion Summary  “The Statement of Actuarial Opinion, the AOS, and the supporting Actuarial Report and Workpapers, should be consistent with the appropriate Actuarial Standards of Practice (ASOPs), including but not limited to ASOPs 9, 23, and 36, as promulgated by the Actuarial Standards Board, and Statements of Principles adopted by the Casualty Actuarial Society.”

7 Actuarial Opinion Summary Details  “The AOS contains significant proprietary information. It is expected that the AOS be held confidential and is not intended for public inspection.”  “The AOS should be signed and dated by the Appointed Actuary who signed the Statement of Actuarial Opinion”

8 Actuarial Opinion Summary Contents  The Actuarial Opinion Summary should include at least the following:  The Appointed Actuary’s range of reasonable estimates for loss and loss adjustment expense reserves, net and gross of reinsurance; and/or  The Appointed Actuary’s point estimates for loss and loss adjustment expense reserves, net and gross of reinsurance; and  The Company’s recorded loss and loss adjustment expense reserves, net and gross of reinsurance; and

9 Actuarial Opinion Summary Contents (continued) And also include:  The difference between the company’s carried reserves and the Appointed Actuary’s point estimate and/or range of reasonable estimates, net and gross of reinsurance; and  Where there has been one-year adverse development in excess of 5% of surplus, as measured by Schedule P, Part 2 Summary, in at least three of the past five calendar years, include explicit description of the reserve elements or management decisions which were the major contributors.
